RICHMOND, VA - DEEDS - Frederick Jones and Richard Carter to William Murphy, sale of slaves Moody, Harry and Salley, 5 May 1807 --------------¤¤¤¤¤¤-------------- THIS INDENTURE made this 5th day of May in the year one thousand eight hundred and seven between Frederick Jones and Richard Carter of the first part, William Murphy of the City of Richmond of the second part and Taylor and Brown and Henry Hovey of said City of the third part. WHEREAS the said Jones and Carter hath this day executed into the said Taylor and Brown, three several notes of hand amounting to the sum of two hundred and ninety one dollars and ninety eight cents, one of the said notes for ninety seven dollars, and thirty two cents, payable in 60 days from the date, the second, for ninety seven dollars and thirty three cents payable in one hundred and twenty days, and the third for a like sum, payable in one hundred, and eighty days, and hath also executed on the same day unto the said Henry Hovey, three other notes of hand, one for one hundred, and thirty three dollars, and forty two cents payablle in sixty days, the other for the like sum of one hundred and thirty three dollars and forty-two cents payable in one hundred and twenty days and the third for the sum of two hundred and eight dollars and twenty-three cents payable in one hundred and eighty days. And the said Jones and Carter being desirous to secure unto the said Taylor and Brown and Henry Hovey, the punctual payment of the said several sums of money at the times they respectively become due and also to secure them for any further sum or sums which the said Jones and Carter may hereafter become indebted unto the said Taylor and Brown and Henry Hovey in, have agreed to execute to the said William Murphy a Deed of Trust: Now, this Indenture witnesseth, that the said Jones and Carter for and in consideration of the promises and for and in consideration of the sum of one dollar to them in hand paid by the said William Murphey, have granted, bargained, and sold, and by these presents do grant and sell, alien, enfeoff, and confirm unto the said William Murphy, his heirs, and assigns three negro slaves by name Moody, Harry and Salley, the first in the possession of Charles Purcell, the second in the possession of Myer Marks and the third in the Possession of Thomas Ritchie, together with the future increase of the said woman unto him the said William Murphey, his heirs and assigns to the only proper use and behoof of athe said William Murphey, his heirs and assigns forever. Upon trust, nevertheless and this exprep condition and for no other intent, use or purpose whatsoever, that is to say, that if the said Jones and Carter or either of them, their or caller of their heirs, executors or administrators, shall make default in payment of either of the aforesaid six notes of hand, at the times they respectively become due, or in the payment of any other note which may hereafter be executed by the said Jones and Carter to the said Taylor and Brown, or Henry Hovey or either of them, at the time, the same is payable; that then, and in either of those cases, it shall, and may be lawful, as often as such default shall happen (at the request of the said Taylor and Brown, and Henry Hovey, or either of them) for the said William Murphey, after giving three weeks' notice of the time and place of sale, in some newspaper, publshed in the City of Richmond to sell at public auction to the highest bidder for ready money, the said three slaves, or such part of them as will be sufficient to pay and satisfy the sum or sums of money, that may be at that time due and owing from the said Jones and Carter unto the said Taylor and Brown and Henry Hovey, or either of them, and the cash and charges of such sale or sales and expences of executing this trust, and after the same shall be fully satisfied, the overplus (if any) return unto the said Jones and Carter or their legal representative. And the said Jones and Carter, for themselves, their heirs, Executors, and Administrators, do covenant and agreee to and with the said William Murphey, his heirs and assigns, that they and each of them, will forever covenant and defend the title to the said slaves against the claim of themselves, their heirs executors and admninistrators and other persons whatsoever. And the said William Murphey agrees and covenants faithfully to execute hereby reposed in him , to the best of his judgment and understanding.
