RICHMOND, VA - WILLS AND ESTATES - Tobias Jackson, 25 Feb 1809 --------------¤¤¤¤¤¤-------------- IN THE NAME OF GOD AMEN, I Tobias Jackson of the City of Richmond and State of Virginia, being of sound mind and perfect memory, do make, constitute and ordain this to be my last will and testament revoking all other Will or Wills heretofore made and devise and bequeath all my worldly goods in the following manner (viz): I give to my beloved wife Martha the house I now live in with a part of the lot on which it stands beginning at the corner adjoining ____(blank) Hancock on the main street leading from the Marked bridge to the Westward runing north, with said Hancock's line until it intersects with Benjamin Taylor's lot, thence runing west with said Taylor's line untill a strait line to be run from said Taylor's line in a pararal (parallel) with Hancock's line above mentioned between the house I now reside in and the house formerly occupied by Nancy Battles, to so divide the space of ground between the said two houses as to give each house an equal part togather with all the appertances thereunto belonging for her own proper use and behoof forever. It is my will and desire that my Executors hereafter mentioned, as soon after my death, as can be done, that they run the dividing line on my lot as described above, and deliver to my said wife, Martha, the part I have given to her and the remainder part of my said lot from the said dividing line (except the graveyard wherein my late wife is buried) to sell for the best price that they can get and in the first place to pay all my just debts and expences attending the settling and division of my lot &c and to pay unto Richard Edwards whatever my said Executors (hereafter mentioned) shall think to be a reaonable compensation for the troble he hath been at in befriending me. Item: Should there be money enough in my said Executors hands after the above desire is complyed with, it is my will and desire that they pay unto my brother Moses Wheeler one hundred dollars and also to his wife Sally one hundred dollars as a compensation for their kindness to me in my illness, but should there not be the amount of two hundred dollars in there hands, I direct that whatever sum may be in their hands under two hundred dollars that the sum shall be equally divided between them, the said Moses Wheeler and his wife, Salley, but should there be more than two hundred dollars, the overplus to be divided in three equal parts to my brother Moses Wheeler and the other equal third part to his wife Salley. I also give all my personal estate of whatever kind or quallity to my wife, Martha, without the formallty of an appraisement. And lastly, I do constitute my friends Robert Hyde and William Dawson both of Richmond City, my Executors to this my Last Will and Testament. Bride A codicil to the Will I have this day subscribed to, which codicil is to be made a part of my said Will and true faith and credit is to be given to the said Codicil as though it had been made and written in the body of my Will, viz: I give to my son Tobias Jackson one shilling current money of the State of Virginia. I give to my son David Jackson one shilling current money of the State of Virginia. Bride At a Court of Hustings Held for the City of Richmond at the Courthouse the 11th day of July 1809 This Will and the Codicil thereafter written were proved by the oath of John Turner, a witness thereto. And At a Court of Hustings Held for the City of Richmond at the Courthouse the 16th day of November 1809 The said Will and Codicil were proved by the oath of Richard Singleton, another witness thereto and ordered to be recorded. And William Dawson, one of the Executors therein named, in open court having refused to take upon himself the burthen of the execution thereof, on the motion of Robert Hyde, the other Executor therein named, who made oath thereto, and with George Williamson, his security entered into and acknowledged a bond in the penalty of two thousand dollars, conditioned as the law directs, Certificate was granted him for obtaining a Probat thereof in due form.
