RICHMOND, VA - WILLS AND ESTATES - Diana Murphey, 10 Feb 1804 --------------¤¤¤¤¤¤-------------- I Diana Murphey of the City of Richmond being at present of sound mind and memory, do freely make this my last will and testament in manner and form following, that is to say: First, I desire that all my just debts and fundral expences be paid. Secondly, After the payment of my debts and funderal expences, I give and bequeath to my friend Jacob Wheaton of the City of Richmond, his heirs, executors, administrators and assigns forever during the full and completed term of five years next immediately enshewing the day of my decease, the service and services of my negro woman slave named Fanny for and during the full and compleat term of term above mentioned, he, the said Jacob Wheaton, his heirs, administrators and assigns to have and to hold the said negro woman Fanny for his or his heirs, executors, administrators and assigns proper use and service in like manner as if she, said Fanny, had been hired to said Jacob Wheaton for a specially or specific valuable consideration in money or property as compensation for service. Thirdly, I give and bequeath to my afforesaid negro woman slave named Fanny and to the future ishue of her body for and in consideration of the faithful services by her to me rendered and done her and their liberty to commence from and on the day and date when the expiration of the term and term of her service to Jacob Wheaton, his heirs, administrators and assigns shall have been complecilly ended as above mentioned of five years, the said service to commence on the day of my death and to continue for five years thereafter and no longer, any thing in the above to the contrary notes that and any and excepting the aforesaid service to be by said negro woman Fanny rendered and done to the aforesaid Jacob Wheaton, his heirs, executors and assigns. I hereby emancipate enfranchise liberate and set free for myself and my heirs in law at equity claiming under my or my right the said negro woman named Fanny as present or slave the title to whom and to her future Ishue I am at present in possession and seised of and also of her person and do hereby emancipate enfranchise liberate and set free said negro woman named Penny and the future ishue of her body forever. Fourthly, I give and bequeath to my beloved friends Mts Polly Wheaton, wife of the aforesaid Jacob Wheaton, and to her heirs administrators executors and assigns forever all and every part of the rest or residue of my estate of what nature or kind whatsoever it may be and herein before particularly disposed of. Fifthly, and lastly I do hereby constitute and appoint my friends Mr. Jacob Wheaton herein beefore mentioned and Mr. William Cook of the City of Richmond Executors of this my Last Will and Testament hereby revoking all others or former Wills or Testaments by me heretofore made.
