RICHMOND, VA - WILLS AND ESTATES - Robert Omberson, 19 Sep 1804 --------------¤¤¤¤¤¤-------------- Will: Robert Omberson, City of Richmond, VA (1804) I Robert Omberson of the City of Richmond do make and ordain the following as my last will and testament, that is to say, I do hereby devise and bequeath unto my beloved wife Polly during her life all the estate both real and personal whereof I may die seized or possess do or have right or title unto and after the death of my said wife, I do give devise and bequeath all my said estate to my four children: Fanny, Polly, Arana and William and to the survivor or survivors of them and to their heirs forever equally to be divided. And I do hereby nominate constitute and appoint my said beloved wife Polly and George William Smith to be Executrix and Executors of this my last will and testament, hereby revoking all other testaments and Wills by me made. IN WITNESS whereof I have hereto subscribed my name and affixed my seal this 19th day of September 1804. (LS) At a Monthly Court of Hustings & Held for the City of Richmond at the Courthouse on Monday the 8th day of October 1804 This instrument of writing purporting to be the nuncupative Will of Robert Omberson and was this day presented in court. Whereupon Enge William Smith, gentleman, being first duly sworn on the Holy Evangelist of Almighty God defivseth? and saith that during the illness which saith preceded the death of the said Robert Omberson, he was called upon to write the last will and testament of the said decedent that the Will not presentd in court was written by this deponent that after writing the said Will he read it to the said Robert Omberson who approved of the same but was unable to execute it and further that he was perfectly in his senses at the time John Allen and John Craddock being also first duly sworn on the Holy Evangelist of Almighty God depose and say that during the last illness of the aforesaid Robert Omberson, dec'd, they were present when the aforesaid Will was written by George W. Smith Esq. at the request of the said Omberson that they saw the said Will read to the said decedent who approved of the same but was unable to execute it and also that he was perfectly in his senses at the time. Whereupon the same is received as the Last Will and Testament of the said Robert Omberson, deceased and ordered to be recorded. And At another Quarterly Court of Hustings & Held for the City of Richmond at the Courthouse on Monday the 14th day of January 1805 On the motion of Mary Omberson in the said Will named who made oath thereto according to law and with William Black and William G. Allen, her securities entered into and acknowledged, their bond in the penalty of one thousand seven hundred dollars, conditioned as the law requires; Certificate is granted her for obtaining Leters of Administration on the Estate of the said decedent with the Will aforesaid annexed in due form.
