RICHMOND, VA - WILLS AND ESTATES - William Pointer, 15 Aug 1807 --------------¤¤¤¤¤¤-------------- IN THE NAME OF GOD AMEN, I William Pointer of the City of Richmond, ordain this my last will and testament hereby revoking all and every Will or testament by me heretofore made. I resign my soul into the bosom of blessed redeemer and my body to it's mother earth! Item: I desire that after my decease, at the discretion of my Executors, that all the part of my estate perishable be sold except such part as my beloved wife Lucy shall choose to take at their value of appraisement and by her to be held upon the same terms and condition, upon which my other estate will be given to her as is herein after mentioned. And out of the debts due me, and the proceed of such sale, my will is that all just debts which I may owe together with my funeral expense, be paid and discharged. Item: I give unto my said beloved wife Lucy, during her life the use of a negro woman known and called Polly Shaw. Also during her widowhood (or until her arrival of age of my eldest child, and the next eldest, and so in succession, the use and controul of my whole estate, but in either want my (will) then is that my said estate upon the arrival or marriage in age to be equally divided among them agreeable to the statute explaining division of intestate's estates. Item: I give unto my said wife during her natural life, the use of two negros, to wit: Frank and Sam now in possession of James Winfree, her brother, and for whom suit is now in depending to recover. Item: I have expectances, by my intermarriage with my said wife, of obtaining slaves and money by donation from her dec'd grandfather, Walter Scott, son and her dec'd Uncle Walter Scott Jr, which said money will come from David Ross at the issue of a suit now depending - my will is on the recovery of this money, be appropriated to the best advantage for the benefit of my several children herein after named as they marry or become of age or the survivors of them. Item: I have feeling in general and equal parental love, I have now in existence, my beloved son Archibald and my dear daughter Elizabeth Frances, heirs of my body by first wife, late Lucy Burns. I have also my beloved child Archibald Agness, heir of my body by my present wife, late Lucy Winfree, now therefore my will is that either, upon the event of my death, without further issue, or with further issue by said beloved wife and in pursuance of the reservation herin before written that my children enjoy the whole of my estate, in common, and by equal division among the whole of them. Lastly, I constitute and appoint my beloved wife my Executrix and my beloved brother Samuel Pointer with my friend Obediah Winfree Executors of this my Last Will and Testament. Signed with own hand and sealed with my seal this fifteenth day of August one thousand eight hundred and seven. Cay Walter Potter Israe Webster At a Monthly Court of Hustings & Held for the City of Richmond at the Courthouse on the 13th day of June 1808 This Will was proved by the oaths of W. Cowan and Walter Potter, witnesses thereto, and ordered to be recorded and and Lucy Pointer, the Executrix, and Samuel Pointer, an Executor therein named, in open Court refused to take upon themselves the burthen of the execution thereof, and the said Lucy relinquished and renounced all benefit which she might claim under the same, which was ordered to be certified. And At a Monthly Court of Hustings & Held for the City of Richmond at the Courthouse on the 14th day of May 1808 Obediah Winfree, the other Executor in the said Will named, by his note in writing addressed to the Court and proved by the oath of a witness thereto, also refused to take upon himself the burthen of the execution of the said Will; which was ordered to be certified.
