Deed of Trust (Abstract) [Marginal Note: P. P. Burton & wife to Benj. Wigginton [emphasis added], for Alex. Shields; D. Trust; Examd; Delivd to P. P. Burton 15 April 1831.] 21 May 1829. Indenture between Patrick Burton and Mary his wife of the first part, Benjamin Wiggington, of the second part, and Alexander Shields the third part. Majr. Samuel Scott of Campbell County in his lifetime settled on Mrs. Aphia B. Rose, wife of William Rose, a tract of land to secure her annual support for life, which land Burton in conformity with the deed of settlement sold for $4,000.00. Burton was appointed by sd. Scott as trustee in the deed of settlement. Burton was required by the Chancellor of Lynchburg district to give security faithfully to manage and account for the fund committed to him as trustee, and Shields is his security of the fund. Burton is desirous to indemnify sd. Shields in his securityship, and to prevent him from sustaining loses thereby. To effect that purpose, the sd. Burton and Mary his wife do bargain and sell to the sd. Wiggington, the following negroes, to wit: Jonas, Nelly, Tumbler, Milley, a woman, Martin, Elisa, Dolley, Milley, an infant, Ben, Louisa. All that part of the tract of land in the County of Bedford on which sd. Burton formerly lived adjoining the lands of Oden G. Clay, Thomas Whittington, Edmund Cobbs, and Clement Jennings which lies on the south side of the Road leading from Trinity Church to Lynchburg. To have and hold the said Negroes to the said Wiggington, and the said land to him; subject to the trust heretofore given to him for the benefit of James Martin, upon this trust that if the said Shields shall become liable to the payment of any money on account of the Securityship aforesaid, the said Wiggington, shall immediately sell in the manner he may find most to the interest of the parties so many of the said negroes as may be necessary to discharge any liability the said Shields may have incurred or to refund any money he have have been compelled to pay on said securityship and if the sale of said negroes shall not indemnify said Shields then said Wiggington, shall immediately sell at public sale after giving reasonable notice as many of said negroes and as much of said land (as can consistently with Martin lien be sold) as may be necessary to raise the sum of money which said Burton must transfer to his successor in said trust. If said Burton should not be relieved from the execution of the trust by the Chancellor the said Wiggington, shall hire out said slaves and rent said lands, after satisfying Martin's lien, or otherwise employ them as shall be most productive, and shall apply the hires and profits to discharge of the claims of Mrs. Rose under the settlement as best to relieve said Shields from all danger in his securityship aforesaid. The said Patrick and Mary Burton for themselves and heirs do warrant to the said Wiggington, and his assigns the title to said land free from the claims of all persons except the lien above mentioned to said Martin. Tolley's security in an injunction issued by the Chancellor of the Superior Court holden at Staunton on a debt due by James Hensly and to Richard Davis and Co. & Micajah Davis and in consideration of the sum of one dollar, to Christopher V. Tolley by Zechariah J. White, do grant bargain and sell unto Zechariah J. White the following personal property: 1 negro boy named Thomas, aged about 17; 6 feather beds and bedding, 2 head of horses; to hold in trust.
