Headley (mjbh@ix.netcom.com) William Thompson Deceased having by his last Will and Testament bearing date on the 14th of August 1854 after giving a portion of his estate to his wife Nancy B. Thompson and a portion thereof to Joseph Thompson, Phebe Moore wife of William R. Moore, Rachel Hamilton, wife of James M. Hamilton, Margaret Grigsby wife of Abner Grigsby, Sallie C. Thompson, John Thompson, James J. Thompson, Lucian H. Thompson and William J. Thompson and having devised the residue of the proceeds arising from the sale of the said estate real and personal, after payment of the legacies given to the parties above named to the said John Thompson, Lucian H. Thompson William J. Thompsn and James J. Thompson and the said Nancy B. Thompson declining to accept the provision made for her by the said will and electing to take the portion of the said estate real and personal to which she is by law entitled where renunciation of the provision made for her in the said will and all of the other parties interested being desirous of receiving the portion of the said estate to which they respectively are entitled -- --the same can be had if the said will is executed strictly in pursuance of its terms and requisitions and this sale of the real estate and Slaves is deferred within the times therein appointed: and the said John Thompson James J. Thompson, Lucian H. Thompson and William J. Thompson, being the only persons interested in the said estate after the portion thereof to which the widow is by law entitled (assigned to her in the manner required by law, and the legacies given by the said will is Joseph Thompson, Phebe Moore wife of William J. Moore, Rachel Hamilton wife of James M. Hamilton, Margaret Grigsby wife of Abner Grigsby, and Sallie C. Thompson are discharged and having determined to make sale of the whole estate real and personal do soon as it can be done conveniently with the exception of sd. much thereof as the widow may be entitled by law do receive and certain articles of personal property to which certain legatees are entitled by specific bequeths with a view to pay off the legacies which are payable in money and distribute the residue of the proceeds of sale among themselves in the proportions to which they are respectively entitled according to the term and provisions of the said last will and Testament of their father William Thompson deceased. Now this agreement made on the 6th day of August A. D. 1853 between the said John Thompson, James J. Thompson and William J. Thompson of the first part and Lucian H. Thompson of the second part: Witnefseth that the said parties of the first part do hereby agree to sell to the said party of the second part the tract of land upon which the said William Thompson deceased resided at the time of his death supposed to contain three hundred and fifty nine acres subject however to the right of the widow to dower therein and to convey the same to the said party of the second part by deed with general warranty us to all other claims upon payment in full of this purchase money for the judgment of which a lien is hereby retained: And the said party of the second part doth hereby agree to pay for the said tract of land subject to the encumbrance of dower above stated sixteen dollars per acre the actual quantity to be ascertained by survey, two-thirds thereof payable on the first day of September A. D. 2856 upon which he is to be credited with the sum of two thousand one hundred and ninety dollars to amount of the legacy to which he is entitled exclusive of his interest in the estate as one of the residuary legatees and the residue of the purchase money payable on the first day of September A. D. 1857 the purchase money when paid to be assets in the hands of the said John Thompson and James J. Thompson as Executors for distribution among the parties hereto entitled under the said will. The growing crops are hereby reserved and the said party of the second part is to have pofsefsion on the first day of September A. D. 1855. It is further understood that the purchase money is to be paid to the said John Thompson and James J. Thompson. Witnefs our hands August 6. A. D. 1855 John Thompson James J. Thompson William J.
