I John Patton of Lexington Virginia being of sound mind & memory but weak in body have thought it proper to make the following distribution of my property (to wit) I give & be- queath to my much beloved Mother Twenty five Hundred Dollars to be disposed of in the following manner, that is I wish five hundred Dollars to be laid out in the purchase of a negro girl for her use & the remaining Two thousand Dollars to be put to interest & to be paid to her annually or as she may want it & at her death to be disposed of as herein after mentioned. Second, I give & bequeath to my brother William Patton Ten Thousand Dollars on condition he conveys his interest in the farm on which my Mother now lives to our brother Ma- thew Patton. I also leave to my sd brother William my horse, watch, clothing & saddle & bridle. Third, I give & bequeath to my brother Mathew Patton Two thousand Dollars. Fourth. I give & bequeath to my sister Elisabeth Willson seven hundred and fifty Dollars. Fifth, I give and bequeath to my sisters Nancy Jamison, Margaret Wasson, Isabella Ireland and Phebe Ireland each five Hundred Dollars. Sixth. I give to my sister Mary Taylor one hundred Dollars as a memorandum of friendship. Seventh. I give & bequeath to my nephew William McDowell Son of my deceased sister Sarah McDowell my tract of land at the mouth of Cumberland in the state of Kentucky con- taining Three hundred acres, when he arrives at the age of Twenty one years to him and his heirs forever. Eight. I give & bequeath to my niece Margaret McDowell daughter of my deceased sister Sarah McDowell five Hundred dollars the interest only to be paid to her untill she either marries or arives at the age of Twenty five years. Ninth. I release my brothers Mathew & William from the pay- ment of any money which may be due to me on acct of debts I have paid that were due by my fathers estate or any money which may be due me from sd estate. Tenth. I direct that after the payment of all my Just debts, the within mentioned Legacys & the costs and charges attending the execu- tion of this will, the surplus if any (& it is expected there will be considerable) shall be paid to my brother William, together with the Legacy left my mother after her death, the negro wo- man not to be included, but to be at the entire disposal of my mother. Eleventh. I direct that my Executors or Administrators do sell & convey all my real estate both in Ohio & this state in such manner as they shall think best. Twelth I direct that after the payment of my Just debts & funeral charges, five hundred dollars shall be next paid for the purchase of a negro girl for my mother & she to re- ceive Interest on the other two thousand dollars from my death. the other legacys not to bear interest until one year after administration on my estate & to be paid as soon as the money can conveniently be collected, & whereas I have a considera- ble number of large debts due me from my customers, I direct that my Executor shall not push or distress any where debts a- mount over four hundred dollars, for at least three years, as owing to the present times & the sise of some of them if sued for immediately they would be nearly ruined, but the above in- dulgence is not to be extended to [caret] any claims which my Executor may think are in danger of being last, unless they shall be well secured. Lastly. I constitute & appoint my intimate friend Wm Willson of Lexington my Executor for the entire settlement of my Estate & in case any difficulty should arise in the settlement of my accts my Executor is authorized to have them refered to Arbitraters whose award he is authorized to settle by, & it is further my wish and directions that the Court shall permit & authorize my Executor to qualify and act as such without giving any security & that he is authorized to charge more than the usual percentage provided the Court think it not unreasona- ble. White At Rockbridge County Court July 1 1822 This writing purporting to be the last will and testament of John Patton decdeased, was produced in Court proved by the oaths of Robert White, Matthew White and Zech J. White the subscribing witnesses thereto, and ordered to be recorded—And on the motion of William Willson the executor therein named who made oath according to Law, and entered into and acknowledged bond in the penalty of Forty thousand dollars (without security according to the directions of said will,) certificate is granted him for obtain- ing probat thereof in due form.
