In the name of God amen, I William Patton of the County of Rockbridge and State of Virginia being in feeble health, but of sound mind and memory, and being desirous of giving effect to the purposes hereinafter mentioned, do make and ordain this writing to be my last will and testament. First, I do hereby direct and authorize my Executors herein after named, or the survivor of either, (provided it should be the wish of my beloved wife to sell and convey the plantation on which I now reside near the Town of Fairfield in the county of Rockbridge: & the pro- ceeds of the same to be distributed between my said wife & children, (as well as all my other estate both real & person- al) in the manner directed by the Laws of Virginia. Second, whereas my late brother John Patton decd. did by his last will and Testament bearing date the 27th day of April 1822, bequeath to me the sum of Ten Thousand dollars, “on condition that I should convey my interest in the farm on which my mother then, and now lives, to my brother Matthew Patton”, and whereas a deed of conveyance ac- cording to the terms of sd will has not yet been made: Now in fulfillment of the condition aforesaid in said will Contained, I do hereby release to the said Matthew Patton all my Interest and title in said farm, and do further authorise and direct my Executors to convey by deed, in fee simple to sd Matthew Patton all my right & Title as a- foresaid. Third, I do hereby constitute & appoint, Samuel V. Gate- wood , & Doctr Alfred Leyburn, the executors of this my last will & Testament. In Testimony whereof I have set my hand & seal, this first day of June in year of our Lord one thousand eight hundred and thirty seven. Wm Patton {seal} Signed, sealed and acknowledged before us as his last will and Testament. Wm Stevens Wm Willson C.P. Dorman At Rockbridge County Court September 4th 1837 This last will and Testament of William Patton decd. was produced in court, proved by the oaths of William Stevens, William Willson, and Charles P. Dorman the subscribing witnesses thereto, and ordered to be recorded—And on the motion of Samuel V Gatewood amd Alfred Leyburn the Executors therein named, who made oath thereto, and together with William Stevens, William Willson, John Alexander and John S. Leech their securities, entered into and acknow- ledged bond in the sum of sixty thousand dollars ac- cording to Law. Certificate is granted them for obtaining a probat thereof in due form of Law.
