James JohnstonÕs Will (Transcription) I James Johnston of the County of Rockbridge & State of Virginia bein of sund and disposing mind and memory do al in a usual state of bodily health but reflecting on the frailty of human nature and the uncertainty of time things have thought proper to make the folowing disposal of my estate. And therefore do make and ordain this my last Will and testament Viz In the first place I order all my Just debts to be paid out of my estate together with my funeral expences in the maner hereinafter directed. I give and bequeath to my beloved wife Jane on half of the plantation that I live on together with half of my household furniture and also the dwelling house during her natural life with the Black woman Milly at her own disposal and also a horse and saddle and five head of cattle and ten head of sheep als ten hed of hogs to be at her disposal likewise. I gave & bequeath to my son Samuel that part of my plantation purchased of RobinsonÕs Exrs as discribed in a Deed to him signed and acknowledged to him but not recorded which he is to consider his full proportion of my estate together with other property that he has recd. I gave & bequeath to my son James my Mill plantation with all its appurtenances containing fifty two and a fourth acres also my black Boy Alfred with the horse and saddle that is now caled his on condition that he pay to my estate three hundred dollars eighteen months from this date. I gave & bequeath to my son Alexander the ballance of the Robinson plantation except what is herein after reserved to have and to hold forever together with a horse saddle & Bridle and the black boy Jacob on condition that he pau to my estate three hundred and twenty five dollars to be paid when he arives at twenty two years of age. I gave and bequeath to my sons Robert and Chapman the plantation on whic I live subject however to my wifes dower as above bequeathed, and also a horse saddle & bridle each. My son John has recd a liberal education and the espence of study and outfit in all beyond his proportion of my estate. I gave and bequeath to my daughter Polly M. my black girl Eliza a good horse saddle & Bridle two beads and beading a Buroe 6 chairs & a table together with other articles to the amount of thirty dollars also two Milch cows & five sheep all which she is to recieve when she marrys or arives at Age of twenty one years. I gave and bequeath to my daughters Margaret, Sally and Jane each a black boy or girl such as my estate can afford to be left to the discretion of my executors also to each of them two beds and beading one Buroe 6 chairs & one table one horse saddle & bridle two Milch cows five sheep and other articles to the amount of thirty dollars to each of them. all which the are to receive when the marry or arive at the age of twenty one years. If my disposable property after paying the foregoing Legacys should be insuficien to pay my debts my Executors are hereby authorised and required to sell that portion of my Robinson plantation which lies above William Hills upper line including all of what is caled the upper bottoms and also a piece of the wood land lying southeast of the road above sd Hills line with a piece of the timbered land lying West of the bottom not to exceed ten acres but should it not be necessary to sell the above discribed Land for the payment of my debts it may be retained for the benefit of my children under age and when the youngest arrives at the age of twenty on or marrys it shall be sold and equally divided among each of my sons and daughters herein mentioned except John M. it is my wish that my sons Robert Alexander & Chapman remain on the plantation and asist in suporting the family untill the marry or arrive at the age of twenty one years an also that the black boys Cam & Willis should be retained for that purpose if the Debts can be paid without selling them. Should any of my slaves prove refractory or unmanageable my executors will sell hem reserving as many as will pay the above Legacys. Any property not herein disposed of shall be put into the hands of my wife to assist in suporting and educating my younger children and after that is done to be at her disposal. My Executors shall imediately after my Decease sell my distillery with as much of my stock and other property as can be spare and aply the proceeds to the payment of Debts. Ruley were sworn and severally deposed, that they are well acquainted with the testators hand writing, and verily believe the said writing and the name thereto subscribed, to be wholly written by the testators own hand. David East John Beard James East At Rockbridge County Court August 1st 1836 This last will and testament of Sophia Miller decd was produced in Court proved by the oaths of David East and John Beard subscribing witnesses thereto and ordered to be recorded. Know all men by these presents, that we James Dunlap and Alexander Dunlap and Samuel F Jordan are held and firmly bound unto Wyndham Robertson acting Governor of the commonwealth of Virginia in the sum of four thousand dollars, to which payment well and truly to be made to the said Governor and his successors in office, for the use of the said Commonwealth: we bind ourselves and each of our heirs, executors and administrators, jointly and severally firmly by these presents, sealed with our seals, and dated the third day of October 1836. The condition of the above obligation is such, that whereas, the above bound James Dunlap hath been by the County Court of Rockbridge constituted & appointed Constable in the said County of Rockbridge, agreeable to an Act of Assembly in that case made and provided. If therefore the said James Dunlap shall well and truly execute and perform the duties of the office of constable according to Law, during his continenance in said office, then this obligation to be void, else to remain inn full force and virtue. And as to such worldly estate as it has pleased God to entrust me with I dispose of the same as follows. First I direct that all my debts, and funeral expences be paid as soon after my decease as possible, out of the first moneys that shall come into the hands of my executors, from any parties of my estate.
