Jane Johnstonıs Will (Transcription) I Jane Johnston of the county of Rockbridge & State of Virginia, do make and constitute the following as & for my last Will and testaemnt, hereby revoking all Wills at any time herebefore made by me. 1 I will and bequeath to my daughter Polly McHenry my black boy Sam. 2 I give & bequeath to my daughter Margaret my two black boys Alexander & Andrew. 3 I give to my daughter Jane Sehorn my black boy John My land warrant I give unto my son James Johnston & my daughter Margaret Johnston, said warrant being now located by my son John M. Johnston, now a resident of the State of Ohio, the papers being now in his possession. And should the relative positions of the Confederate States to the United States be such that my son James & my daughter Margaret cannot inherit the proceeds of my siad land warrant then I direct that it remain in the hands of my said son John M. Johnston, if not already taken possession of by the United States. All the money inherited by me from the estate of Polly McCorkle I will and bequeath to my two daughters Margaret Johnston & Polly McHenry. My black girl Milly I will and bequeath to my daughter Polly McHenry Margaret Johnston, Jane Sehorn & the children of my daughter Sally Rapp equally, the children of my daughter Sally RApp having their portion equally. All my personal property of every description I will to my daughter Margaret Johnston, also all moneys that may accrue to me hereafter from any source whatsoever. As to the estate of my son Chapan Johnston, both real & personal, so far as I may be lawfully or otherwise interested, I am willing that it (said estate) shall be equally divided between the heirs at law of my son Chapman Johnston. I appoint my son James Johnston agent for my daughter Sally Rapp children & direct him to take care of & manage their interest in my estate to the best advantage for them. Lastly. I make, constitute and appoint my son James Johnston Executor of this my last Will and testament. In testimony whereof, I hereunto set my hand and affix my seal on this 13 day of august one thousand eight hundred and sixty two in the presence of the undersigned, who subscribed in the presence of each other. James Agner and Adam Nicely on bond as admrıs of David Agner dec'd. 6 August 1867. ************************************************************************** DAVID PULSE, 1867 Rockbridge County, VA Will Book 18, pp. 602-604 David Pulse's Will (Abstract) "I David Pulse of Rockbridge County, State of Virginia, being in feeble health, but of sound and disposing mind and memory, do make this my last will and Testament, in manner and form following, viz." 1st-- After "my decease, my body shall be decently interred in a manner suitable to my condition in life. " 2nd-- After " my decease," Executors herein named to pay "my funeral expenses and just debts." 3rd-- "to my beloved wife Susanna, her dower interest in my plantation." Executors shall have the same laid off "as soon after my decease as practicable." She is also to have ³her choice of my two horses, two of my cows, all my House-hold and kitchen furniture, my two horse wagon, and the gears used therewith, one plow and one Harrow." She and her two youngest children who are with her shall be supported for one year after "my decease" out of the proceeds of the estate. This property so enumerated is to be held "by my said wife, for and during her natural life, and whatever of it shall remain at her death, shall be disposed of by my Executors, for the benefit of my Estate." 4th-- At the death of "my wife, my lands shall be divided equally, regard had to quality and quantity, between my sons, Charles Pulse, David Pulse, George Pulse, Levi Pulse, John Pulse, Saml. Pulse, Erasmus Pulse, and my daughters, Lydia Eve Pulse, and Mary C. Pulse, & Ellen Bowman, the wife of Jacob Bowman, to them and their heirs." 5th-- The portion which shall fall "to my daughter Ellen Bowman, shall be held by my son George Pulse, who is hereby appointed a Trustee for that purpose." He is to pay over the profits to ³my said daughter Ellen, taking her receipt attested by two disinterested witnesses." Such sums to be paid to her for support of herself and her children, ³Jacob Bowman, her husband, is not to have anything to so with his wife's interest in my estate, but it is intended for the sole use of herself an her children, free from his control in every respect.³ 6th-- to "my daughter, Rachel Doyle, the wife of ____ Doyle, one cow, worth twenty dollars, and this is all I intend she shall receive of my estate." 7th-- to "Ellen Holler, who intermarried with Jacob Holler, Catherine Pulse, and John Pulse, children of my deceased son Harrison Pulse, on shilling each to be paid by my Executors, within one year of my death." 8th-- to "my sons Samuel and Erasmus, the colt which each one now claims, as his own, and which I always intended for them." 9th-- "my Executors, to make sale of the residue of my personal property, not herein before specifically bequeathed, for the payment of my debts, and I further direct that after the assignment of my wife's dower in my hands, the residue of land shall be rented out, and the rents applied to the payment of my debts, until all shall be discharged." [10th] 9th-- "I hereby revoke all wills by me at any time heretofore made." [11th] Lastly-- "I constitute and appoint my sons David Pulse and Levi Pulse, sole Executors of this my last __ and testament, and I request that they be allowed to qualify without being required to give security." On the motion of David Pulse & Levi Pulse the Executors named in the said will; who made oath thereto and without security, according to the condition of said will, entered into and acknowledged a bond in the penalty of six thousand dollars, conditioned according to law, certificated was granted them to obtain a probate of said will in due form, said bond is ordered to be recorded. "It is ordered to be recorded that the Estate passing by the will was estimated not to Exceed $3000, that $1.50 stamp duties were paid on the probat [sic] of said will, and $1.00 on the Executor's bond." The road leading from the public road through the farm past the Barn and house to the widow's land shall be kept open for the benefit of both the widow and those occupying the residue of the farm and shall not be closed except by gates or bars that may be easily opened. The fencing running near the division line from the bend of the road rear of No. 43 to No. 46 shall be regarded as a division fence and shall be moved to the dividing line and the edge of the road, running near said line, shall be moved to the edge of said line where it is not already near the edge.
