All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Romaine Stauffer staufferhof@comcast.net October 15, 2014, 7:19 am Written: December 15, 1817 Rockingham County Burnt Deed Book 3, pages 501-02 page 501 This Indenture made the fifteenth day of December in the year 1817 Between Peter Burkholder & Elizabeth his wife of the County of Rockingham and State of Virginia of the one part and Anthony Auker of the County and State afore- said of the other part, Witnesseth that the said Peter and Elizabeth Burkhol- der for and in consideration of the sum of Seventeen hundred and forty Dollars lawful money of Virginia to them in hand paid by the said An- page 502 thony Auker the receipt whereof is hereby acknowledged hath granted bargained and sold, and by these do grant, bargain and sell to the said Anthony Auker and his heirs and Assigns one certain tract or parcel of Land containing one hundred and eight & three quarter acres (being a part of three tracts viz: first it is a part of a tract of two hundred and forty five acres conveyed to the said Peter Burkholder by his father Peter Burkholder since deceased, by deed dated June 9, 1807, the second part is a part of 62 acres more or less devised by the said Peter Burkholder deceased, to the said Peter Burkholder by will dated-------------- both of which tracts were parts of an inclusive patent tract of 555 acres, granted said Peter Burkholder deceased by patent dated Decem. 24, 1801—And part is a tract of sixty-one & a quarter acres more or less Conveyed by Martin Coffman by deed dated October 19, 1795) lying in the County of Rockingham on a branch of Cedar run, Beginning at two white oaks Corner to David Burkholder's land and with the lines of Joseph Trissels land S 48 W3 poles to a White oak N 58 degrees W 24 poles crossing a branch to an ash, N 23 degrees E 54 poles to a Locust N 55 W 31 poles with a fence to a locust stake N 2 degrees W 22 poles with a lane to between two white oaks in a road, N 80 degrees W 21 poles with said road to between in hickory and two black oaks North 531/2 poles to two black oaks N 87 degrees W 44 1/2 poles to a white oak on the Patent line & with the Patent lines S 18 1/2 degrees W 30 1/2 poles to a black oak, formerly a hickory corner to Harris land and with his lines lines S 25 degrees E 5 poles to a large white oak S 31 degrees W 51 poles to a hickory shrub goods corner and with his lines S 24 degrees E 124 poles to a Locust Stake, S 42 1/2 degrees 669 poles crossing a branch to a Locust Stake said Goods corner N 33 1/2 E 84 1/2 poles to a black oak David Burkholder's corner, and thence with his line N 63 1/2 W 22 1/2 poles to the Beginning Together with all and singular the appurtenances thereunto belonging or in any wise appertaining To Have and to hold the said one hundred and eight acres & three quarters of Land with its appurtenances unto the said Anthony Auker his heirs and assigns forever, to the only proper use and behoof of him the said Anthony Auker & his heirs and assigns forever, and the said Peter and Elizabeth Burkholder for themselves and their heirs, executors and administrators, doth covenant with the s'd. Anthony Auker and his & his heirs and assigns, that they the said Peter and Elizabeth Burkholder and their heirs, executors and administrators the said Land with its appurtenances unto the said Anthony Auker and his heirs and assigns against the claim or claims of them the said Peter and Elizabeth Burkholder & their heirs, and of all and every person or persons whatsoever, shall and will warrant and forever defend by these presents, In witness whereof the said Peter and Elizabeth Burkholder hath hereunto set their hands and seals on the day and Year first above written Signed sealed and delivered Peter Burkholder (seal) In presence of Elizabeth (X her mark) Burkholder (seal) Rockingham County, to wit: We Joseph Baxter and Giles Turley Justices of the Peace in the County aforesaid in the State of Virginia, do hereby certify that Elisabeth Burkholder the wife of Peter Burkholder partis to a certain Deed for the conveyance of real Estate, to Anthony Auker bearing date the 15 day of December 1817 and hereunto annexed personally appeared before us in our County aforesaid, and being examined by us, privily and apart from her husband, and having the Deed aforesaid fully explained to her, she the said Elizabeth Burkholder acknowleged the same to be her act and deed, and declared that she had willingly signed sealed and delivered the sand, and that she wished to not retract it. Additional Comments: According to the old oral story, Peter Burkholder Sr. died on a visit to Lancaster County, Pa., and was buried in the Groffdale cemetery in 1799.
