All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Romaine Stauffer staufferhof@comcast.net November 30, 2014, 5:32 pm Written: August 31, 1812 Recorded: September 1812 1812 Samuel & Elizabeth Good to Jeremiah Kyle, Rockingham County, Virginia, Burnt Deed Book 36, pp136-140 Pg 136 This Indenture made this 31st day of August one thousand eight hundred and twelve between Sam- uel Good and Elizabeth his wife of Dauphin County and State of Pennsylvania of the one part and Jeremiah Kyle of the County of Rockingham and State of Virginia of the other part Witnesseth that the said Sam- uel Good and Elizabeth his wife had for and in consi- deration of the Just sum of one hundred Dollars paid by the said Jeremiah Kyle the receipt Whereof they the said Samuel Good and Elizabeth his wife doth hereby acknowledge hath granted bargained and sold and by these presents do grant bargain And sell unto the said Jeremiah Kyle his heirs and assigns for ever each of them his undivided one thirteenth share in and of A certain tract or parcel of Land contain- ing one hundred and twenty acres be the same more or Less lying and being in the County of Rockingham Joining of other land belonging to the said Jeremiah Kyle also his A part of a larger or parcel of Land con- taining five hundred and thirty nine acres of land and was conveyed by William Cravens and Jane his wife unto Jacob Good Dec’d. By a deed of bargain and sale bearing Date the day of March 1804 And Duly recorded in the County of Rockingham with an explanation of the title papers hereunto belong- ing the said Jacob Good Dec’d. Dying without first publishing his Last Will and Testa- ment the fee simple Estate in and of the said Decec’d. and descended to Samuel Good Pg 137 and others being heirs apparent at law and legal Descendants of the aforesaid Deceased Jacob Good and bounded within the following lines to wit Begin ning at a Sycamore a corner of an old patent And a corner of John Brock’s land thence with brocks line North seventy four and a half Degrees west one hundred and Seventy four poles to A white oak on brocks line a corner of said Kyles land thence with their lines and crossing the tract South Twenty Degrees west forty two poles to a Stone Thence South Seventy four degrees East Seventy three poles to a stone in a road thence South fifty four Degrees East forty Four poles to a stake South thirty two and a half Degrees East Eighteen poles to the Upper Corner of the Milk house thence Round three sides of the same south twenty and a fourth Degrees West 24 links of the chain South Sixty Eight and ¾ of one Degrees East twenty 23 links thence North twenty one and fourth Degrees East twenty four links of the chain to the N. East corner of the said Milk house as aforesaid thence North Eighty Five and a half Degrees East thirty poles crossing the Ditch to Gate post near a pine tree thence South Sixty five Degrees East two hundred and seventy four poles to two pine trees on a line of Peter Browns land thence with said line North forty two Degrees West Eighty Eight poles to white oak thence North Sixty six Degrees West Ninety poles to a pine and black oak thence North Seven and a half Degrees East twenty Seven poles crossing A hollow to a pine a corner of the aforesaid John Brocks Land Thence with the same North fifty three and a half Degrees West Sixty four poles to the beginning Together with all and Singular Pg 138 the appurtenances therewith belonging in any wise appertaining to have and to hold the said four thirteenth parts of the said tract or parcel of Land Containing one hundred and twenty acres as aforesaid be the same more or Less with the said Jeremiah Kyle his heirs and assigns forever except a water wright Excepted in the before mentioned Deed of Cravens to the said Jacob Good Deceas’d. And the said Samuel Good and Elizabeth his wife for themselves And their heirs Executors and adminis- trators do grant bargain sell make over and convey unto the said Jeremiah Kyle his heirs and assigns forever all their right title Interest and Claim in and of the before mentioned Tract or parcel of land as above Described And will Warrant and Defend the same from them and their heirs or assigns or any of them claiming or to claim any right or title there- with Whatsoever Except that already Excepted In Witness whereof the said Samuel Good and Eli- zabeth his wife have herewith set our hands and seals the day and year first above written Signed Sealed and Delivered Samuel Guth (Seal) in the presence of Jacob Boas Elizabeth X Good (Seal) George W Nutz Pennsylvania, Dauphin County, Pa On the thirty first of August A.D. 1812 personally appeared in open Court of Common Pleas held at Harrisburg in and for the County of Dauphin the above nam- ed Samuel Good and Elizabeth his wife page 139 and acknowledged the foregoing writing to be their Act and Deed and Desired that the same might be recorded as such according to Law the said Eliza- beth being of full age and specially and apart from her said Husband Examined and Voluntarily consented thereto without any compulsion of her said Husband Witness my hand and seal of the said Court the day and year first above written Jacob Boas Rect. (Seal of Dauphin County Common Pleas) I John Glouininger one of the Judges of the Court of Common Pleas for the County of Dauphin in the State of Pennsyl- vania presiding at a court of Common Pleas held in and for the said County on the 2nd day of September 1812 do certify that the within attestation is in sure form Witness my hand the 2nd day of September Anno Domino 1812 Jno Glonnger Pennsylvania Dauphin County Jst. I Jacob Boas proth- anatory of the Court of common pleas held at Harris- burg in and for the county aforesaid Do Certify that John Glouinger Esquire by whom the above attesta- tion is signed in and at the time of signing the same was duly commissioned and qualified as one of the Judges of the several courts of Dauphin County and that all due faith and credit is and ought to be given to the said as will in Courts of Dauphin as thereout In testimony whereof I have hereun- to set my hand and caused the seal page 140 of the said Court to be affixed this second day of September Anno Domino one thous- and eight hundred and twelve Jacob Boas Prot. Rockingham County Superior Court Sept. Term 1812 This deed of Bargain and sale from Samuel Good and Elizabeth his wife to Jeremiah Kyle was presented in court and the same having been acknowledged by the said Samuel in Court of Common Pleas for the County of Dauphin and State of Pennsylvania and duly certified is ordered to be recorded Teste. H J Gambill esq. Additional Comments: Samuel Good of Dauphin County, Pa. was one of the sons of Jacob Good who moved from Lancaster County, Pa. to Virginia about 1795 and died in Rockingham County in 1805. Samuel and his brother Jacob (who died before his father) remained in Dauphin County when their father moved to Virginia. Their brothers, Abraham, Martin, and Peter remained in Lancaster County, Pa.
