Wm. J. Miller to Timothy Funk Deed - 1882 - Rockingham Co., Va. This Deed made this 1st day of May 1882 between Wm. J. Miller and Leanna his wife of the first part and Timothy Funk of the second part all of the county of Rockingham and State of Virginia, Witnesseth that the said parties of the first part for and in consideration of the sum of five hundred dollars cash in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, have granted, bargained, sold and conveyed, and by these present do grant, bargain, sell and convey unto the said party of the second parta certain piece of land situate, lying and being in the said county of Rockingham, at the head of Brock's Creek, adjoining the lands of Joseph McMullin, Perry Funk, Perry Tappy, and George Bible containing forty acres more or less, being the remainder of a tract of one hundred and sixty-five acres formerly sold to John Stinespring, including all the water rights belonging to the property herein described. viz: twelve feet on the east side of the race, adjoining the land of Perry Tappy, including the spring and the said parties of the first part covanent that they will warrent generally the property herein conveyed, that they have a right to convey the same, that the said grantee shall have quiet possesion of the same free from all encumbrance, that they will execute such further assurances as may be requisite, and that they have done no act to encumber the said land. Rhodes, a Notary Public for the county aforsaid in the state of Virginia, do certify that Wm. J. Miller, whose name is signed to the writing hereto annexed bearing date on the first day of May, 1882, has acknowledged the same before me in the county aforsaid. Given under my hand this 1st day of May, 1882, Jos. W. Rhodes, Notary Public I, Jos. W. Rhodes, a Notary Public for the county aforsaid in the state of Virginia, do certify that Leannah Miller, wife of Wm. J. Miller, whose names are signed to the writing hereto annexed bearing date on the first day of May, 1882, personally appeared before me in the county aforsaid, and examined privily and apart from her husband, and having the writing aforsaid explained to her, she, the said Leannah Miller acknowledged the said writing to be her act and declared that she had willfully executed the same and does not wish to retract it.
