All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: John Hymo john.hymo@ucumberlands.edu January 23, 2013, 4:40 pm Written: November 21, 1809 This Indenture made this 21st day of November 1809 by and between Catharine Tutwiler widow and relict of Leonard Tutwiler Deceased John Keister and Fanny his wife Henry Tutwiler Jacob Tutwiler, Peter Whitesal and Mary his wife Frederick Brock and Elizabeth his wife John Sipe and Catharine his wife Robert McClung and Anna his wife George Whitsal and Susanna his wife, and Jonathan Tutwiler the heirs and representatives of Leonard Tutwiler Deceased of the one part and John Tutwiler of the county of Rockingham and the state of Virginia of the other part Witness that the said Catharine Tutwiler John Keister and Fanny his wife Henry Tutwiler Jacob Tutwiler, Peter Whitesal and Mary his wife Frederick Brock and Elizabeth his wife John Sipe and Catharine his wife Robert McClung and Anna his wife George Whitsal and Susanna his wife, and Jonathan Tutwiler for and In consideration of the sum of one thousand six hundred and Eighty Dollars to them Paid as directed by the last will and testament of the said Leonard Tutwiler Dated the 25th day of June 1804 and now on record in the county court of Rockingham to them paid by the said John Tutwiler the receipt whereof they the said Catharine Tutwiler and the heirs and representatives of the said Leonard Tutwiler Deceased as afforesaid doth hereby acknowledges acquit and Discharge him the said John Tutwielr they the said Catharine Tutwiler widow and relict of Leonard Tutwiler Deceased John Keister and Fanny his wife Henry Tutwiler Jacob Tutwiler, Peter Whitesal and Mary his wife Frederick Brock and Elizabeth his wife John Sipe and Catharine his wife Robert McClung and Anna his wife George Whitsal and Susanna his wife, and Jonathan Tutwiler hath granted bargained and sold aliened and Confirmed and by these presents ? grant bargain sell alien, release and confirm unto the said John Tutwiler, his heirs and assigns for ever all hat trail or parcel of land situated lying and being in the County of Rockingham on the waters of Custiss’s Creak containing by estimation one hundred and twenty six acres being part of three tracts of the first containing one hundred and ten acres which was convey to the said Catharine Tutwiler by a Deed of bargain and sale dated the 17 of September 1794 by Samuel Gibson and now on record in the County Court of Rockingham the second containing 218 acres granted to John Sauner by patent letters dated the first day of September 1780 and by him the said Leonard Tutwiler by a deed of bargain and sale dated the (blank on the deed) day of (blank on the deed) the third containing thirteen acres graned by Patant sellers date the 16th day of March 1799 unto him the said Leonard Tutwiler and bounded as follows to witt Beginning at a hiccory black oak and pine Strickler’s and Jonathan Tutwilers corner thence with Strickler’s line north twenty five degrees west ninety eight Poles to a brake in Stricklers field on a ridge thence south sixty five deees west forty two poles to a black and white oak Stricklers corner then north eighty degrees west eighteen poles to a black oak on a line of his other land thence with a line of the same south seven degrees west twenty nine and a half poles west to a white oak by a road thence south thirty degrees west sixty six poles to a white oak saplin thence south thirty one degrees east fifty three poles to a white oak saplin thence south sixty degrees east one hundred and forty four poles to a white and black oak, thence north sisty three degrees east six poles to a locust Jonathan Tutwilers corner thence a ? the tract with his line north ten degrees and a half west one hundred and thirty two poles to the beginning all of which the said one hundred and twenty six acres or whatsoever is contained within the afforesaid ? and distances be the same more or less together with the appurtenances thereto belonging or in any wise appertaining to have and to hold the said trail of land with its appurtenances unto the said John Tutwiler and his heirs or assigns for ever to the sole use and behoof of him the said John Tutwiler and his heirs or assigns for ever and the said Catharine Tutwiler widow and relict of Leonard Tutwiler Deceased John Keister and Fanny his wife Henry Tutwiler Jacob Tutwiler Peter Whitesal and Mary his wife Frederick Brock and Elizabeth his wife John Sipe and Catharine his wife Robert McClung and Anne his wife George Whitsal and Susanna his wife, and Jonathan Tutwiler and their heirs all and singular the promises heretofore granted shall and will from time to time and at all times hereafter warrant and for ever defend the said tract of land with its appurtenances unto the said John Tutwiler and his heirs or assigns for ever against the just claim of Catharine Tutwiler widow and relict of Leonard Tutwiler Deceased John Keister and Fanny his wife Henry Tutwiler Jacob Tutwiler, Peter Whitesal and Mary his wife Frederick Brock and Elizabeth his wife John Sipe and Catharine his wife Robert McClung and Anne his wife George Whitsal and Susanna his wife, and Jonathan Tutwiler hath ? unto ? our hands and ? our seals the day and year just before written.
