VanPelt of the one part and James H. VanPelt Trustee for Lucinda Vanpelt the wife of Andrew J. VanPeltof the other part, all of the County of Rockingham and State of Virginia. Witnesseth, that the said Benjamin S. VanPelt for and in consideration of the natural love and affection he has and bears for his mother the said Lucinda VanPelt, and of one dollar to him in hand paid the receipt whereof is hereby acknowledged, do grant unto James H. VanPelt as trustee for the uses and purpose hereinafter set forth a certain house and lot of land lying and being in the Town of Harrisonburg - County & State aforesaid on Water Street opposite the Tan Yard of H.J. Gray & Co. and adjoining the lots of Rachael Hicky, Judge John Kenny & others and being the same lot of land conveyed by Patterson Graines & wife to the said Benjamin S. VanPelt by deed bearing date as the 19th day of December 1864 and duly recorded in the Clerk’s office of the Court of Rockingham. It is distinctly understood that that the said James H. Vanpelt shall hold the said property for the sole and separate use of the said Lucinda VanPelt --- from the contracts debts or liabilities of her husband Andrew J. VanPelt and all the rents, issues, and Proffits of said property to go to and disposed of by the said Lucinda VanPelt in such manner as she may choose. It is further understood and agreed that the siad Lucinda VanPelt may at any time direct and require (?) the siad James H. VanPelt trustee to sell and convey the said property and apply the proceeds of the sale in such manneras the said Lucinda VanPelt may direct, the consent of said Lucinda VanPelt must be signified in writing to be recorded with deed to be made by said trustee, and if the said Lucinda VanPlet shall fail to make such sale then she may dispose of the same by her last will and testament and in the event of no such sale or will the said property shall descend and become the property of her legal heirs.
