Rockingham County Clerk's Office Deed Book ___, Page 498 This Indenture, made this 23th day of December, 1840, between Benjamin VanPelt of the town of Harrisonburg, county of Rockingham and State of Virginia, executor of Peter VanPelt deceased, of the first part, and Joseph Cromer of the County and State aforesaid of the second part, Witnessseth that whereas, by the last will and testament of Peter Vanpelt deceased, his executor was authorized and required to make sale of the real estate of which the said Peter Vanpelt dec'd seized and possessed after the death of the widow of said Peter Vanpelt, and the widow having departed this life --- thereto the said Benjamin Vanpelt did proceed, on the 23th day of November 1840, in pursuance of said will, to sell to the highest bidder the real estate of which the testator died seized and the said Joseph Cromer being the highest bidder became the purchaser at twenty dollars per acre, and the quantity being ascertained by recent survey to be One Hundred and Sixty three acres four poles, the amount was acertained to be $3264.50 and by the terms of the sale one third of that sum being payable on the 23rd of December 1841, 1842 and 1843, therefore in consideration of the premises and in further consideration of the sum of one Dollar, by the said Joseph Cromer to the said Benjamin Vanpelt, in hand paid, the receipt whereof is hereby acknowledged by the said Benjamin Vanpelt executor of Peter Vanpelt hath granted bargained and sold and by these presents doth grant, bargain and sell unto the said Joseph Cromer his heirs and assigns, the tract of land of which said Peter Vanpelt was seized and possesed at his death and which is situated in Rockingham County adjoining the lands of said Joseph Cromer, Charles Beards heirs and others, containing by recent survey 163 acres and 4 poles, and bounded as follows, viz: Beginning at a large white oak, Cromer's corner on the side of the Harrisonburg road, thence S 8 1/2 E 80 poles to a stone corner to the six acre patent, and with the ___ S 66 E 43 3/4 poles crossing the road to a white oak, Beards corner, and with his line S 81 1/2 W 81 1/2 poles crossing the road again to a black oak stump near a branch, one of the old patent corners, and with the lines of the same S 23 1/2 W 12 poles to a fallen scrub oak and thence S 60 E 142 8/10 poles to the beginning. Together with all and singular the appurtances thereunto belonging or in anywise appurtaining, to have and to hold the land embodied within the boundaries aforesaid, with its appurtences unto the said Joseph Cromer and his heirs and assigns against the claim or claims of him the said Benjamin Vanpelt and his heirs and of all and any person or persons whatsoever, claiming under or through him, he the said Benjamin Vanpelt, as executor aforesaid shall and will by these presents forever warrant and defend. In testamony whereof the said Benjamine Vanpelt hath hereunto subscribed his name and affixed his seal on the day and year first above written.
