Daniel Whitmer, et al to Martin & Ephraim Whitmer deed - 1847 - Rockingham Co. This Indenture made the thirteenth day of May in the year 1847 between Daniel Whitmer and Malvina his wife and Mary Whitmer of the County of Rockingham and State of Virginia, of the one part, and Martin Whitmer and Ephraim Whitmer of the County and State aforesaid, of the other part, witnesseth that said Daniel Whitmer and Malvina his wife and Mary Whitmer for and in consideration of the sum of Six thousand one hundred and fifth dollars lawful money of Virginia to them in hand paid by the said Martin Whitmer and Ephraim Whitmer the receipt whereof is hereby acknowledged have granted, bargained and sold, and by these presents do grant, bargain and sell to the said Martin Whitmer and Ephraim Whitmer and their heirs and assigns a certain tract or parcel of land lying and being in Rockingham County containing one hundred and fifty three acres and three quarters it being a part of a track of two hundred and five acres that Jacob Whitmer died seized, of and bounded as follows to wit: beginning at a stake Martin Whitmers corner, on the west side of the main road and running thence S 47 W 7 1/2 poles to a pine corner of a five acre track, thence with a line of the same N 36 W 40 1/2 poles to a pine Wilbergers corner, on longs line, thence with the same S 72 E ten poles to a pine corner to Adam Long, thence with his line N 29 E 52 poles to three pines corner of old patent, and with a line of the same S 74 E 118 poles to a stone in Joseph Altissers (?) field thence S 19 E 14 poles to a stone in Jacob Whitmers field, thence S 74 E 61 poles to a white oak now fallen down, thence S 10 E twenty poles to a pine, thence S 75 E 26 poles to a white oak at Doubts (?) fence thence with his line S 24 W 137 poles to a Locust stump thence N 82 1/- W 30 poles to between two white oaks thence S 87 W 21 1/2 poles to between a black oak and a white oak corner to the five acre tract, thence with a line of the same S 26 1/2 E 40 poles to two white oaks corner to Safleys (?) Lane thence N 38 W 75 poles to a stone Martin Whitmers corner, thence with his lines N 39 E 115 poles to a stone thence N 48 W 30 1/- poles to a wild cherry tree, thence N 76 W 15 poles to an apple tree, thence N 45 1/2 W 92 poles to a white oak on the east side of the main road, thence S 47 W 16 poles across the main road to the beginning. Together with all and singular the appurtenance thereto belonging or in any wise appertaining to have and to hold the said Tract or parcel of land with its appurtenances unto the said Martin Whitmer and Ephraim Whitmer their heirs and assignes forever to the only property use and behoof of them the said Martin and Ephraim Whitmer their heirs and assigns forever, and the said Daniel Whitmer and Malvina his wife and Mary Whitmer for themselves and their heirs, executors and administrators do hereby covenant with the said martin Whitmer & Ephraim Whitmer and their heirs, executors and administrators the said track or parcel of land with its appurtenances unto the said Martin Whitmer and Ephraim Whitmer and their heirs and assignes against the claim or claims of them the said Daniel Whitmer and Malvina his wife and Mary Whitmer and their heirs and all every persons whatever, shall and warrant and forever defend by these presents. In witness whereof the said Daniel Whitmer and Malvina his wife and Mary Whitmer have hereunto set their hand and seal on the day and year first written. Kyle Justices of the Peace for the County aforesaid, in the State of Virginia, do hereby certify, that Malvina Whitmer the wife of Daniel Whitmer parties to a certain Deed bearing date the 13th day of May 1847 and hereunto annexed, personally appeared before us in our County aforesaid, and being examined by us privily and apart from her husband, and having the Deed aforesaid fully explained to her, she, the said Malvina Whitmer acknowledged the same to be her act and deed, and declared that she had willingly signed and delivered the same, and that she wished not to retract it. This Deed from Daniel Whitmore & wife to Martin Whitmore &c was this day presented to me Deputy Clerk of said county and was acknowledged and is admitted to record Teste C H Gambill DCRC {{Also attached}} On the 1st day of June 1842 Daniel Whitmore executed a deed of Trust on his land, to Thomas Clarke Trustee to secure a debt of $1000 & interest from the 10 of February 1840 to me, which debt I hereby acknowledge has been paid to me in full, and I authorize a release of the land and agree and bind myself my heirs &c to this effect that if Martin and Ephraim Whitmore take a deed from Daniel Whitmore for said land I will never require any payment of the debt aforesaid and will never order a sale of the land. As witness my hand & seal. May the 6th 1847. I order Jude Gamble the put the date of deed of trust to this release (?) Frederick Cupp Mr. John Kenny You are Trustee in a deed of Trust given by Daniel Whitmore on a tract of land, to secure a debt of one Thousand Dollars to me which deed of trust was admitted to record on the 7th of May 1844, and bears date May 6th 1844. The debt of $1000 & interest thereon which was secured by said deed of trust, has been paid, and I hereby authorize and request you to release said land whenever it is required by said Daniel Whitmore or his ___.
