Vanpelt, all my personal property, household and kitchen furniture. 3rd_The house and lot on German St.in the town of Harrisonburg, now occupied by the family of W.S. Kennedy and which appears on the Commissioners Books in the name of Andrew McClellan’s Estate I bequeath to my two sons, Daniel H. Vanpelt and James H. Vanpelt, in equal parts, (share and share alike) they first being required to secure to Sallie Greiner, the daughter of Patterson Greiner, the sum of Fifty dollars, to be paid to her when she arrives at the age of 21 years, said sum of fifty dollars to bear interest at the rate of 6 percent per annum from the date of my death until she is 21 years of age. 4th_Should anything ever be recovered by my Estate in a certain suit in the Circuit Court of Rockingham County against the Estates of R.C. Mauck or A.C. Bryan, or against any person or persons claiming under them I desire that the amount of said recovery shall be divided equally between my two sons, Daniel H. and James H. Vanpelt (share and share alike). Lastly, I hereby appoint my son, James H. Vanpelt, the Executor of this my last will and testament. Ragan Philo Bradley In the County Court of Rockingham County, September Term (Sept 24) 1879. The writing purporting to be the last will and testament of Mrs. Mary Vanpelt, decd was this day presented in Court and proven by the oath of Philo Bradley, one of the subscribing witnesses thereto, and continued for further proof. Same Term, (Sept. 25, 1879) The writing purporting to be the last will and testament of Mrs. Mary Vanpelt, which was partially proven on yesterday, by the oath of Philo Bradley, one of the subscribing witnesses thereto, was this day again presented in Court and was fully proven by the oath of Robert B. Ragan, the other subscribing witness thereto, admitted to probate and ordered to be recorded. And thereupon, James H. Vanpelt, the Executor therein named, who made oath thereto according to law, appeared in Court and together with D.H. Vanpelt, his surety (who justified as to his sufficiency) entered into and acknowledged a bond in the penalty of $500.00 conditioned according to law, waiving the benefit of the Homestead exemption as to this obligation, a certificate is granted him for obtaining a probat of the will of said Mary Vanpelt decd in due form.
