This Indenture made ye Seaven & twentieth day of July Ao. Do. 1632, in ye Eight yeare of yee reigne of our Sovraigne Lord charles by the grace of God King of England Scottland ffrance & Ireland defender of the faith &c Between Capt Henry Woodhouse Esqr(1) on ye one part [mark] Witness.th that the said Captaine Henry Woodhouse in Consideracon of the naturall love and affection hee hath and beareth unto his said Sonne Henry, and for his better advancement hath given granted Bargained Sold & Confirmed & by these prsents doeth clearly fully & absolutely give grant Bargaine sell & confirme unto the said Henry Woodhouse his sonne his heires and assigned all those two Shares of land lying & being in yee Summer Islands otherwise called Barmudas(2) in yee parts beyond the Seas in a certaine tribe there called or knowne by the name of Hamiltons tribe als. Harrington tribe late in yee Tenure & occpacon of John Gering of London(3) or his assignes wch said two shares of __________________________________________________________ (1) See Article "Henry Woodhouse" in the QUARTERLY for April 1893. (2) See the will of Henry Woodhouse in the same number of the QUARTERLY. (3) A word occurs here which I cannot make out, but think it is probably grocer. Page 263. land yee said Capt Henry Woodhouse lately purchased to him & his heires forever of the said Jno Gering by Indenture of Bargaine & Sale baring date yee 7th day of august @ Do. 1628 in the fourth yeare of the reigne of or Said Sovraigne lord King Charles as by the Same Indenture may appeare. To ahve and to hold ye said two shares of land aforesaid & the Soiles Grounds havens Creeks ports rivers waters & all & singular the prmises with the appurtenances Except such Royalties perogatives benefitts & Comodities as are belonging to the Kings matie & yee Governor & Compa of ye Sumer Islands and their Successors unto the said Henry Woodhouse yee son his heire and assignes for ever to yee only pper use and behoof of him the said Henry Woodhouse the sone his heires & assigned forever. In witnes whereof the said parties to this prsent Indentures Interchangeably have sett their hands & Seales the day & yeare first above Written. HENRY WOODHOUSE. Note that I the Subscriber Wm Porten(1) Clerke of the Court upon Examination of the originall conveyance from Capt Henry Woodhouse Esqr to his Sonne doe find that these words following (viz) (and Henry Woodhouse gent Sonne of the sd Capt Henry Woodhouse on the other part) ought to bee Enterlined beetweene the words part and wittnesseth in the fourth Line wheare you find this mark [sign]. Test: WM PORTEN, Cl Cur. The Opinion of Governor Diggs. "Lower Norfl att a Court held the 15th day of January Ao. 1655. Present - Coll John Sidney Mr Tho: Daines Lt Coll Lambart Mr Edm: Bowmans Capt ffra: Emperor Mr John porter Senr(2) Mr Wm Daines Mr John porter Junr(3) - Commissioners. "Gouvernor Digges his opinion Concerning A Clause in Mr Henry Woodhouse his Will(4) Recorded the 15th January 1655 My opinion is that ye devise in these words, and the remainder to be equally devided amongst my children, All ye Children(5) as well by the former ___________________________________ (1) Clerk of the court of Lower Norfolk County, Virginia. (2) and (3) John Porter Sr., and John Porter, Jr., were brothers. (4) See will of Henry Woodhouse in the QUARTERLY for April, 1893. (5) In giving the names of the children of Henry Woodhouse in the QUARTERLY for April, 1893, that of Frances, his daughter, was left out by oversight. Page 264. as the Latter Wife shall have theire share & it seems plaine yt the Legacies of five shillings to the former, & the Silver spoones to the Latter, doe not take away the first Guift. This should have beene plact in Mrch: 56: Edward Digges".
