Deed Book 15; Page 151; Scott County Virginia This deed made this 7th day of August 1870 Between William H. Bays of the first part and Eliza Bays his former wife, Darthula Bays, Reuben Bays, Nathaniel Bays, Oliver Manson Bays, Melvin Bays, Edney E. Bays, Ceney M. Bays and Rufus G. Bays of the second part; Witnesseth that in consideration of a difficulty existing between the said Wm. H. Bays and Eliza Bays his former wife and which brought about a divorcement of the parties from each other and a division of the real estate, the said William H. Bays the first party doth grant and give to the parties of the second part a certain tract or parcel of land lying on the north side of Clinch Mountain in the County of Scott State of Virginia. It bounded as followeth, to wit, Beginning at a planted rock about 3 poles east of an ash and poplar corner of Wm. H. Bays and Jessee Browning ___ land on the top of a ridge near the house in which the said Eliza Bays now lives, thence a strait line nearly south 70 poles to the northeast corner of a piece of land sold by the said Wm. H. Bays to F. J. Vicars, thence a northwesterly course with a line of said Vicars passing said Vicars corner and Lewis Francisco’s corner to a white oak and past oak, a corner of the said Bays, thence nearly north to a white oak on a ridge corner of said Bays, B. Nickles, and B. Shoemaker thence to a pin oak, spanish oak and cedar southward to an ash and hickory nearly east to six hickories. Shoemaker and Browning comes top of a ridge and thence with Browning line along the top of the ridge to a poplar and ash, thence 3 poles to the beginning as followeth to wit, the said Eliza Bays is to have two tenths, to Darthula Bays one tenth, to Reuben Bays one tenth, to Nathaniel Bays one tenth, to Oliver Manson Bays one tenth, to Melvin Bays one tenth, to Edney E. Bays one tenth, to Ceney M. Bays one tenth and Rufus G. Bays one tenth of the above described land and which is the western portion of the said Wm. H. Bays tract of land, the residue of his lands, he Wm. H. Bays retains to himself. The said Eliza Bays hereby relinquishes all claims she has or may have as right of dower, to the portion of land retained by said Wm. H. Bays and she Eliza Bays is to make her right to the land sold to F. J. Vicars and the said Eliza Bays further binds herself to maintain and care for all of the above named infant children during their minority and is to keep and have possession of them free from any claim of the said Wm. H. Bays. Witness the following signature and seal Stamped 50 cents William H. Bays seal Virginia: Scott County, to wit; Wm. H. Bays party to the foregoing deed personally appeared before me a justice of said county and acknowledged the same to be his act and deed. Given under my hand this 7th day of November 1870.
