I Ulrich Waggoner of the County of Shenandoah and State of Virginia, being weak in body but of sound and disposing mind and memory, and calling to mind the mortality of my body - I do make and ordain this my Last Will and Testament in the following manner and form - first I give and devise unto my grand son John Tiesinger his Heirs and assigns One hundred and five Acres and a half acre of Land lying in the said County of Shenandoah it being part of that tract of Land whereon I now live joining lands belonging to the Lutheran Congregation, and the lands of Henry Hoshaur, George Keller, & George Rinker, as the same was surveyed & laid off for him the said John Tiesinger by Jacob Rinker, Item I give and devise unto my duaghter Betty for and during her natural life the remainder of my said Tract of Land whereon I now live containing one hundred and sixty Acres .. as the same was surveyed and laid off by the said Jacob Rinker and after her decease I give the said one hundred and sixty acres of Land with the appurtenances to the same belonging unto my said daughter Bettys son Joshua Foltz and his Heirs forever but if my said grand son Joshua Foltz should die without having lawfull Heirs of his body then in that case the said one hundred and sixty acres of Land shall be equally divided amongst the rest of my children to wit: Elizabeth the wife of Peter Tiesinger Barbara the wife of Henry Penninger and Christina the wife of Henry Rinker and their Heirs Share and Share alike that is to say each of my said three daughters or her Heirs to have one share, Item I Give and devise unto my said Grand son John Tiesinger his Heirs and assigns Seventy five Acres of Land lying in the said County of Shenandoah at the Cove Ridge being Granted to me by patent bearing date the first day of October in the year of our Lord One thousand eight hundred: Item I Give and devise unto my said three daughters Elizabeth the wife of Peter Tiesinger, Barbara the wife of Henry Penninger and Christina the wife of Henry Rinker and to their Heirs and assigns forever the following two tracts of Land to wit one tract containing Three hundred and fifty Acres lying and being in the said County of Shenandoah on the three mile mountain & near Stony Creek..being granted to me by patent bearing date the twelfth day of July in the year of our Lord one thousand seven hundred and ninety two. the other tracct containing four hundred and seventy five Acres lying & being in the said County on the drains of Mill Creek it being granted to me by patent bearing date the first day of October in the year of our lord one thousand eight hundred - Item I give and devise unto my said daughter Elizabeth and her husband Peter Tiesinger an account which I have against them for money &c advanced to the amount of Seventy eight pounds and two shillings current money of Virginia and I do give unto my said Grand son John Tiesinger & his Heirs the sum of Twenty pounds Item I Give unto my said Grand son John Tiesinger & his Heirs the sum of Twenty pounds Current Money of Virginia - - Item I Give unto my said Daughter Barbara the wife of Henry Penninger or her Heirs the sum of One hundred pounds Current money of Virginia - Item I Give unto my said Daughter Christina the wife of Herny Rinker or her Heirs the sum of one hundred pounds current money of Virginia Item it is my will that all the grain and hay which shall be on hand at my decease shall be for the use and benefit of my said daughter Betty and my two Grand sons John Tiesinger and Joshua Foltz - - and further it is my Will and I do direct that all the remainder of my Estate real and Personal or of whatsoever kind or nature it may be not hereinbefore given & devised shall be equally divided amongst my before named four daughters Betty, Elizabeth, Barbara and Christina and their Heirs Share and share alike so that each of my said daughters or their Heirs have one equal share. and whereas I have sold a plantation and tract of Land lying in the County of Rockingham to a certain Richard Hughes but have not yet made him a title for the same - now it is my Will and I do direct that my Executor herein after named shall make a good lawfull and sufficient Title, as I have unto the said Richard Hughes on his the said Hughes paying to my said Executor the money which he yet owes me for said land and in all things complys and fulfills a contract entered into Between the said Richard Hughes and my self. And I do hereby ordain constitute and appoint my trusty friend Jacob Rinker sole Executor of this my last Will and Testament - Revoking and disannulling all and every other Will or Wills by me heretofore made. Ratifying allowing and confirming this and no other to be my last Will and Testament In Witness whereof I the said Ulrich Waggoner have hereunto set my hand and seal as and for my Last Will and Testament this tenth Day of May in the year of our Lord one thousand eight hundred and one -- -- 1801.
