WHITELY DEED, SMYTHE CO., VA File contributed for use in USGenWeb archives by Diane Younker (DianeY@linkline.com) Deed book of Smythe Co., VA, Book 5, pages 613 and 614 This deed made this twenty first day February in the year 1853, between Samuel Whitely and Rebeca his wife of the one part, and William J. Whitely of the other part, all of Smythe County and State of Virginia, witnessed: That the said Samuel Whitely and Rebecca his wife for and in consideration of the sum of seven hundred fifty dollars secured by personal security do grant unto the said William J. Whitely, the following track and interest in tract of Land viz: A tract of Land containing forty acres more or less lying and being in the County of Smyth on the waters of the north fork of Holston river and bounded as follows: viz: Beginning at a white-oak corner of Robert Whitely's land and on a line of a tract sold by John Deskins to George Johnson thence to run a straight line to a chestnut, white-oak and sowerwod a corner agreed on by the parties and marked as such, thence along the top of the ridge in a southwesterly direction nearly opposite a spring so as not to include it in the land, to Whitely. Thence to run as near a north course as possible to hit a cucumber corner of a track of land that John Deskins sold George Johnson, now owned by James McVey, or supposed to be a corner to the land Deskins bought of William Mitchell, and with R. Whitely's lines to the beginning. Being the land conveyed by John Deskins to said Samuel Whitely by deed of date 19th of June 1841, and record in Smythe County Court, also the said Samuel Whitely's undivided interest consisting of fourth part in a tract of land revised by Robert Whitely the father of said Samuel Whitely to George Whitely, Samuel Whitely, Robert Whitely and James Whitely, supposed to contain one hundred and sixty fix acres, and the said Samuel Whitely and Rebecca his wife, warrant the aforesaid tract of land, and undivided interest in aforesaid 165 acres of land to said William J. This Deed of bargain and sale from Samuel Whitely and wife, to William J. Whitely, was acknowledged in the clerks office.
