Nelson m Mary "Polly" Daley in Roane co., TN 30 January 1815. John E. and a William Nelson served in the War of 1812 in the East Tennessee Militia, although pension applications have not been found. Have not found record of Daley/Daily families in Roane co., TN. I am wondering if Mary Daley b ca 1795 SC might be a sister of James Daily b ca 1794]. MLJ Document dated 3 March 1855: Smyth co, VA, Elizabeth Daily aged 60 years states is widow of James Daily deceased;her husband was a private in company commanded by Captain Bibb, regiment of East Ten. Commanded by Col. Coulter in war with Creek & other Indians,in Green co., TN about 1812-13 for 6 months. States married James Daily in Chesterville, SC 8 January 1818 by one John Boyd, a Justice of the Peace and her name before marriage was Elizabeth Clinton; husband died at Elizabethton, TN 24 January AD 1835. Elizabeth (her X mark) Daily Witness: R. W. Jones, Marion, Smyth County, Virginia. Affidavit: Jacob Myers states was well acquainted with James Daily and Elizabeth Daily his widow. Witness: Wm. D. Welmore and P.S.M. Killinger, residents of Smyth Co., Virginia Document 11 August 1855: Smyth co, VA, Elizabeth Daily states she is widow of James who died Elizabethton Tennessee 24 January AD 1835, for purpose of obtaining bounty land to which she may be entitled. Elizabeth (her X mark) Daly Affidavit: Susan C. Jones and Clementine Daily, residents of Smyth County, VA Virginia declare Elizabeth and James did live together as husband and wife. Printed 'fill in blanks' form dated 9 July 1878: Elizabeth Daily aged 81 of Smyth County Virginia is wid of James Daily who served as Private in company commanded by Capt. Hale in the Infty commanded by Col. Williams in the War of 1812. States James was 20 years old at time of enlistment, occupation carpenter, born South Carolina, was Six feet high, black hair, blue eyes, complexion fair. Stated married Chester District SC on 8 January 1818 by John Boyd, Justice of the Peace. Her maiden name was Elizabeth Clinton, and neither ever married before. Stated husband James Daily died at Elizabethton, TN on 24 January 1834. Stated she and her husband had lived in Green County, Tennessee; Chester District South Carolina; and Elizabethton, Carter County, Tennessee. Appointed A. M. Davis of Lynchburg, VA as her attorney. Stated she obtained a Land Warrant in 1857 which she sold to Madison ?Hopp or ?Hoss of Jonesboro, Tennessee. Elizabeth (her mark) Dailey Witnesses: Jas. H Francis age 51 of Marion, VA and Wm. C. Seaver age 55 years of Marion, VA, state they saw her place her mark on affidavit, each has known her for thirty years. Certificate of Pension dated July 16, 1878, attorney A. M. Davies of Lynchburg, VA. States based on application 29.136 Elizabeth Daily of Marion, Smyth Co., VA, widow of James Daily, Capt. Hale's Co. died January 25 1834. Received Bounty Land #71848-160-55 and Service Pension. Unsigned U.S. Army form dated 28 May 1879 and on same page Army Vouchers both dated 4 March 1880 state Elizabeth Daily received total $48.00 for 6 months, Received of D. T. Boynton, U. S. Pension Agent at Knoxville, Tennessee. Affidavit 22 March 1879, Smyth County, Virginia, Elizabeth Daily states "old and as far as she remembers she believes her said husband was drafted in the month of November 1813 in the Militia from the County of Green State of Tennessee under Capt. Joseph Hale and discharged May 1814. She is confirmed in this believe by the Statement of Samuel Mathers who was a (?) of her husband. Elizabeth (her X mark) Daily Witnesses, residing at Marion, Smyth County, Virginia: Jane Da?meron aged 48 and Clementine Daily aged 57 years. Affidavit 8 May 1879, Smyth County, Virginia. Elizabeth Daily states she believes the land warrant was for 160 acres and that she sold said warrant to J. M. Hoss of Jonesboro Tennessee and that R. W. Jones was the attorney who prosecuted her claim. Elizabeth (her X mark) Daily Witnesses: Clementine Daily aged 56 years; Mary Parish aged ?47/?49 years Form date-stamped 3 Sep 1881 by U. S. Pension Agency, Knoxville, Tenn. States Elizabeth Daily's last pension payment was to 24 April 1880, has been dropped because of death. "Paid Samuel B.
