Mabry Shff March 1799 Dismissed for want of a Bill [page end] [images 0539 & 0540 - subpoena] The commonwealth of Virginia to the Sheriff of Southampton county greeting You are hereby commanded to Summon Matthew Britt to appear before the justices of our Sd. court at the Courthouse of the Sd. county on the third mondy in September next to answer ["Joseph Brother of" struck] a Subpoena in Chancery exhibi =ted against him by Joseph Britt and this he Shall in no wise omit under the penalty of £100 and have then there this writ witness Saml. Kello clerk of our Said Court at the Court =house of the Sd. county the 21st. day of June 1798 and in the 22d. year of the common wealth Saml. Matthew, Matthew v. Joseph, & Benjamin v. Matthew - combined and referred to William BAILEY & Elias HERRING. Joseph died by Feb 1803, causing his suit to abate, but it was reinstated by his administrator John URQUHART.
