We the commissoners, after having duly and Publickly Advertised, on the thirteenth of October made sale of all the land conveyed by William Raiford to Arthur Bowen and Micajah Griffin Executors of John Carstaphen dec.d Subject to the dowable claim of the Widdow, On a credit of twelve Months except one hundred dollars which was to be ready money as mentioned in the decree, Which land sold for thirty one Pounds and a shilling, but the debt due the Executors being twenty Eight Pounds ten shillings & 4.d leaves a ballance of two Pounds ten shillings and 8.d which balance is bonded to the children on demand at the expiration of twelve Months from the Day of sale Given from under our hands this 23.rd Day of October 1803.~ John Bowers Joseph Denson William Pope X his Mark [brief #3 (Image #199)] [notes on back] Carrstarphen ex.rs} vs } Int'y Decree Raiford &c} September 1803 December 1803 Com. to exam Witns. rep.t res.d & decree final~ [1st page of 1 (Image #200)] So'ampton September Court 1803 Arthur Bowen and Micajah Griffin exe.rs of John Carrstarphen dec.d plffs } Against } In Chancery Mildred Raiford widow and relict of William Raiford dec.d and Elizabeth Raiford Sarah Raiford, & Eldridge Raiford infant children of the said William by Thaddeus Powell their guardian for this purpose appointed Deft } This cause was docketed by Consent, heard on the bill and answer on Consideration whereof it is decreed and ordered that John Bowers Joseph Denson Carr Bowers and William Pope or any three of them make Sale of the land which the s.d William Raiford Conveyed to the Said ex.r to Secure a debt due to them Subject to a dowable claim of the widow on a Credit of twelve months (except one hundred dollars which is raised in Cash) taking bonds to the executors for the amount of this claim (after deducting the afores.d one hundred dollars) against the s.d W.m Raiford and bond for balance to the Commissioners for the benefit of the said orphans And assign the Same in equal proportions to the afores.d orphans or their legal representative and make Report in Order to a final decree Sam'l Kello Cl [brief #4 (Image #201)] [notes on back] Carstaphany's ex'ors } vs } Ch'y Raiford's widow & heirs } Hill. [1st page of 2 (Image #202)] To the Justices of So'ton County Court in Chancery sitting- Arthur Bowen & Micajah Griffin ex'ors of John Carstaphany dece'd humbly shew, that a certain William Raiford of the Co. afs.d being indebted to the said Carstaphany in their lifetime in the sum of thirty one pounds 18/2 good & lawful money of Virginia with a view of securing the Payment thereof, by a deed of mortgage entered into on the 12.th day of September 1802 conveyed to the s.d ["Carstaphany" struck out] ["exors" carated in, struck out] Arthur & Micajah one certain tract or parcel of land lying in the Co. of So'ton containing 200-acres as will appear by the deed therefor, which hath been duly recorded in the Co. Court afs.d, and which your Compl'nts make a Part of this bill- That there being no ex'or nor adm'or of the s.d Raiford it becomes proper to resort, to the effect of the instrument aforesaid, ["and" struck out] Your Compl'nts further shew that the s.d Raiford left a widow by the name of Mildred and four Children under the age of twenty one years- ["That they have applied to the s.d Widow, viz, William" struck out] viz, Elizabeth Sarah, & Eldridge- That they have applied to the s.d Mildred, who is willing that sale may be made of the lands afs.d reserving ["to" struck out] her dower ["in" struck out] therein- but the Children by reason of their infancy cannot give any consent, in consideration whereof to the end ["therefore" struck out] that the s.d Mildred widow &c, and the s.d infants may be made Defts hereto, and answer the allegations of this bill and that a Guardian may [page break] be appointed them to defend- That this Court will decree & order that sale may be made of the land & Premises afs.d (subject to the widow's dowable claim) ["and appoint com'ers for allotting the Dower & carrying the" struck out] for the Purpose of raising the afs.d sum of money with interest thereon from the time it became due, & costs- in the following manner ['$']100.00 in cash & the residue in 12 mo.s credit taking bond &c to the ex'ors as far as the demand, & the bal. to the Com'rs for the benefit of the s.d infant heirs of W.m Raiford dece'd- Or make any other Decree & order so as shall be deemed most proper- May it Please the Court the Com'wlth's S'pa ['subpoena'] to grant, directed to the Defts, Commanding them to appear here &c &c &c. He made an indenture to the executors of John CARSTAPHEN to secure a debt due CARSTAPHEN, 12 Sep 1802 {proved 16 May 1803 & 19 Jul 1803} (DB10:128-29); see also Order Book, p. 13 {6/17/1799} & p. 351 {5/16/1803}). It was sold (by court decree) to Carr BOWERS, 28 Oct 1803 {proved 19 Dec 1803 & 20 Feb 1804} (DB10:257-58). This matter is the subject of Southampton Co. Chancery Suit 1803-021.
