Present, The Hon. J.W. Urquhart Judge [,,,] [p.] 284 [...] William Urquhart, Foreman, C.C. Willliams, A.B. Urquhart, W.H. Urquhart, J.W. Norfleet, Henry J. Webb, M.F. Lamb, Geo. W. Stephenson, John T. Branch, Joseph E. Warren, R.S. Fagin, James R. West, Charles Knight, B.F. Harrison, W.K. Stephenson, Wm. H. Drewry, R.N. Allman, Peter Person & F. Dunn, were Sworn a Grand Jury of Inquest for the body of this County, & having received their charge withdrew, and after Some time returned into Court and Presented, An Indictment vs. Elbert Branch, for Felony, "A true bill," An Indictment vs. Richard Green, for Felony, "A true bill," & the Said Grand Jury having nothing further to present were discharged. [...] [p.] 291 At a Court held for the County of Southampton at the Court house thereof on monday the 16th. day of September A.D. 1878. Present, The Hon. J.W. Urquhart Judge [,,,] [p.] 293 [...] Elbert Branch who Stands indicted of felony was led to the bar in Custody of the jailor of this Court & being thereof arraigned ple= =aded not guilty to the Indictment, and a pannel of Sixteen persons Summoned by the Sheriff, were examined by the Court found free from all legal exceptions and qualified to Serve as jurors according to law. Thereupon the accused peremptorily challenged four of the jurors and the remaining twelve to wit; Geo:H. Darden, Augustus Crumpler, J.W. Moore, J.L. Gillette, Aurelius Edwards, A.A. Holland, Edwin Williams, G.W. Williams, W.H. Stephenson, R.J. Williams, Jno:G. Kello and R.B. Joyner, who being elected tried and Sworn the truth of and upon the premises to Speak & having heard the evidence upon their Oaths do Say; "We the jury find the Prisoner guilty and ascertain his term five years in the Penitentiary." And thereupon the Said Elbert Branch is remanded to jail. [...] [p.] 299 Tuesday Morning September 17th. 1878. Present Hon. J.W. Urquhart, Judge Elbert Branch who stands convicted of felony was again set to the bar in Custody of the Jailor of this Court & it being demanded of him if anything for himself he had or Knew to say why the Court here Should not now pronounce Judgement against him ac= cording to law and nothing being offered or alleged in delay of Judgement, it is Considered by the Court that the said Elbert Branch be imprisoned in the penitentiary of this Commonwealth for the term of five years the period by the Jurors in their verdict ascertained. And it is ordered that the Sheriff of this County do as Soon as possible after the adjournment of this Court remove and safely Convey the Said Elbert Branch from the Jail of this County to the Penitentiary of this Commonwealth, therein to be kept imprisoned and treated in the manner directed by law for the period aforesaid and thereupon the said Elbert Branch is remanded to Jail.
