Cook a pedlar exhibiting in the Town of Jerusalem Three Shalls [shawls] of the value of Three Dollars and Two combs of the value of fifty cents -( The Court Summoned for her examination not having met) and thereupon divers witnesses were Sworn and [large "X" in margin] examined on behalf of the commh. Touching the premises (to wit) Nicholas F. Cook, James A. Gray, Matthew Calvert & Jesse Drewry - The court after hearing the testimony and all the circumstances of the case (and the prisoner being fully heard by counsel) are of the opinion that the prisoner ought to be tried for said offence at the next quarter Session court to be holden for this county in the month of June next & thereupon it is ordered that the prisoner be remanded to Jail. +- [page break] [Min.Bk. p.] 83 Be it Remebered that Nicholas F. Cook, James A. Gray, Matthew Calvert & Jesse Drewry here in court acknowledged themselves indebted unto his Excellency Thomas M Randolph Governor or chief magistrate of this comm.th and his Successors in office for the time being in the Sum of $333_33 1/3 to be levied of their respective Land & Tenements [large "+" in margin] goods & chattels, to the said Governor for the use of the com.th rendered- Yet upon this condition, that if they and each of them Shall per- =sonally appear before the county court of Southampton, at the courthouse On the 3_rd Monday in June next then and there to give Such evidence as they and each of them, know on behalf of the comm.th against Elizabeth Uzzell who Stands charged with Larceny & shall not depart thence without leave of the court then this recognizance to be void or else to remain in full force & virtue -- [break] [O.B. p.] 136 [...] [At a court held for the county of Southampton on the fifteenth day of May 1820] == Elizabeth Uzzell who was this day Set to the Bar by the Sheriff of this County into whose custody she was heretofore committed and charged with having on the 29.th day of April last, stolen, taken and carried away, from the Stand of Nicholas F. Cook a pedlar exhibiting in the Town of Jerusalem, three shalls [shawls] of the value of three dollars and two combs of the value of fifty cents ( the Court summoned for her examination not having met,) and thereupon divers witnesses were sworn and examined on behalf of the Commonwealth, touching the premises to wit, Nicholas F. Cook, James A. Gray, Matthew Calvert, and Jesse Drewry here in Court acknowledged themselves indebted to his Excellency Thomas M Randolph Esq. Governor or Chief Magistrate of this Commonwealth in the sum of three hundred and thirty three dollars 33 1/3 cents each of their respective goods and chattels lands and tenements to be levied and to our said Governor and his Successors for the use of the Commonwealth rendered. Yet upon this condition that if the said Nicholas F. Cook, James A. Gray Matthew Calvert and Jesse Drewry and each of them Shall severally appear the Commonwealth's Justices of the Peace for this County at the Court house on the third Monday in June next to give Such evidence as they and each of them know on behalf of the Commonwealth against Elizabeth Uzzell who Stands charged with Larceny, and Shall not depart thence without the leave of the said Court then this recognizance to be void ~ == [break] [Min.Bk. p.] 88 At a court of quarter Session held for the county of Southampton on the 19_th day of June 1820 Pres.t Jeremiah Cobb, Benj.a W. Johnston Law. Cook & Peter Booth __ Gent. [...] -- Thomas Fitzhugh foreman Edwin Pope, Henry J. P. Westbrook, James Wright, Samuel Barham, Thomas James, Joseph S. Joyner, Charles Bryant, John Wommack, Nath.l Simmons, Edward Reese, Nath.l Rochelle, Britton Britt, Sam.l Story, John West, James Pond, W.m Davis, Abraham Gardner, Burwell Williams, & Thomas Williams were Sworn & Robert Ricks of Thomas one of the people called quaker, being affirmed, a grand jury of inquest upon the body of this county after hearing their charge were sent out of court & after Some time ret.d & presented as follows, An Indictment against Eliz.a Uzzell A True Bill and the Grand Jury having nothing further to present were discharged [large "+" in margin] -- [break] [Min.Bk. p.] 90 [...] +- Elizabeth Uzzell late of the parish of Nottoway in the county of S.o'ton who Stands Indicted for Petit Larceny was this day led to the bar by the Sheriff of this county into whose custody she was heretofore committed and charged [smudged] thereof arraigned ["pleaded guilty and" struck] and upon her [large "X" in margin] arraignment pleaded guilty [sic!] and thereupon came a Jury (to wit) Jeremiah Joyner, Eley Draper, Jason Rowe, John Stephenson, William West, James Williams, Matthew Mountford, Eley Joyner, Daniel Williams, Matthew Joyner, Benj.a Brister, & Benj.a Bradshaw who being elected tried sworn & affirmed ["upon their oaths & Solemn affirmations do say "that the the prisoner" struck] the truth to say of and upon the premises were sent out of court to consult of their virdict, and after Some time ret.d into court & ["declared" struck] [blank; verdict not given here] [page end] [O.B. p.] 152 [...] ------------------- Elizabeth Uzzell late of the parish of Nottoway and County of Southampton who stands indicted for Petit Larceny was led to the bar in custody of the Jailor of this County thereof arraigned and pleaded not guilty to the indictment Whereupon, came a Jury to wit, Jeremiah Joyner, Eley Draper, Jason Rowe, John Stephenson, William West, James Williams Matthew Mountford, Eley Joiner, Daniel Williams, Matthew Joyner, Benjamin Brister, and Benjamin Bradshaw who being elected tried and Sworn the truth of and upon the premises to speak and having heard the evidence . . . . . . . . . . . . . . . . . were sent out of Court to Consult of their verdict and after some time returned and were adjoined till to morrow morning OClock _ ------------------- [break] [Min.Bk. p.] 93 [...] At a court of quarter Session continued & held for the county of S.o'ton on the 20_th day of June 1820 Pres.t John C. Massenburg Gent Eliz.a Uzzell late of the parish of Nottoway in the county of S.o'ton who stands Indicted for petit Larceny was again led to the bar in custody of the jailor, and the jury Sworn yesterday to ["try the issue require" struck] assertain the term of her im= [large "+" in margin] =prisonment in the public jail or penitentiary house of the comm.th or the number of lashes she shall receive on her bare back upon their oaths do Say that they have assertained the term of her imprisonment in the public jail & penitentiary house of this com.th to be Nine Months & that the goods so stolen are forthcoming to be restored to the owner - and thereupon it is ordered that She be remanded to jail -- [break] [O.Bk. p.] 157 [# in later hand & pen] At a Court of quarter Session continued and held for the County of Southampton the 20.th day of June 1820~ Present, John C. Gray, Benjamin W. Johnson } } Gent. Justices Benjamin Griffin & James D. Massenburg } ------------------- Eliza Uzzell late of the County of Southampton who stands indicted of Grand [sic!] Larceny was again led to the bar in custody of the Jailor of this County and the jury sworn yesterday to ascer= tain the term of her imprisonment in the public jail and Penitentiary house in the Common= wealth, or the number of lashes she shall receive on her bare back, upon their oath do say that they have ascertained the term of her imprisonment in the public Jail and penitentiary house of this Commonwealth to be nine months.: And further the Jurors upon their oath do say that the goods and chattels stolen are now forthcoming so as to be restored to the owner thereof, And thereupon the said Eliza Uzzell is remanded to Jail ~ ------------------- [break] [Min.Bk. p.] 102 [...] [At a court of quarter Session continued & held for the county of S.o'ton on the 20_th day of June 1820] -- Elizabeth Uzzell- late of the parish of Nottoway in the county of Southampton who Stands convicted of Petit Larceny was again led to the bar in custody of the Sheriff of this county into whose custody She was heretofore committed, and thereupon it being demanded of her if any thing for herself She had or knew to say why the court here Should not now proceed to pronounce judgement against her according to Law, and nothing being offered or alledged in delay of Judgement: It is considered by the court that the said Eliz.a Uzzell [large "X" in margin] be imprisoned in the public jail and penitentiary house of this comm.th for the term of Nine Months the period by the Jury in their virdict assertained and that She be kept in a Solitary cell in the Said Jail & penitentiary house on low & coarse diet for the space of one Tenth part of the said term of Nine Months- And it is ordered that the Sheriff As Soon as possible after the adjournment of this court convey the said Eliz.a Uzzell to the said Jail & Penitentiary house- and the court certify that on the Trial of the Said Eliz.a Uzzell nothing appeared to them either in aggravation or extenuation of the said offence- -- [break] [O.B. p.] 168 [...] [At a court of quarter Session continued & held for the county of S.o'ton on the 20_th day of June 1820] -- Elizabeth Uzzell late of the parish of Nottoway in the County of Southampton who stands convicted of petit Larceny was again led to the bar in custody of the Sheriff into whose custody she was heretofore committed, and thereupon it being demanded of her if any thing for herself she had or knew to say why the Court here should not procede to pronounce Judgement against her according to Law, and nothing being offered or alledged in delay of judgement. It is considered by the Court that the said Eliza Uzzell be imprisoned in the public Jail and penitentiary house of this Com- monwealth for the term of nine of nine [sic] months the period by the Jury in their verdict ascertained and that She be kept in a Solitary cell in the Said jail and Penitentiary house on low and coarse diet for the space of one thenth [sic] part of the said term of nine months And it is ordered that the Sheriff as soon as possible after the adjournment of this Court convey the said Eliza Uzzell to the said Jail and Penitentiary house And the Court doth certify that on the [page break] [O.Bk. p.] 169 [# in later hand & pen] trial of the said Eliza Uzzell nothing appeared to them either in aggravation or extenuation of the said Offence- -- [break] [end] Southampton Co., VA, Court Minute Book 1819-1824, pp. 82-83, 88, 90, 93, 102.
