All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records Thomas BOYKIN & wife Mary to Joshua WOMBWELL, deed of bargain & sale, 262 & 85 acres, 22 Nov 1751 (14 Feb 1752) bond, 25 Nov 1751 (14 Feb 1752) [margin notes] Boykin & ux to Wombwell This Indenture made the Twenty Second Day of November in the Year of our Lord Christ one thousand Seven hundred & fifty one Between Thomas Boykin and Mary his Wife of the Parish of Nottoway in the County of Southampton of the one part and [page break] [p.] 324 ŻŻŻŻ Joshua Wombwell of the Same Parish & County of the other part Witnesseth the said Thomas Boykin & Mary his wife for and in Consideration e of the Sum of Nin^ty Six pounds Currant money to him in hand paid by the Said Joshua Wombwell at or before the ensealing and delivery __ here of the Receipt whereof the said Thomas Boykin doth hereby acknowledge and thereof acquit & discharge the said Joshua Wombwell Have and each of them Hath Granted Bargained Sold aliened enfeoffed &Confirmed and by these Presents Do and each of them Doth Grant Bargain Sell~ alien enfeoff and Confirm unto the said Joshua Wombwell his Heirs and Assigns forever All that Tract or parcel of Land lying & being in the said parish of Nottoway & County of Southampton Containing by Estimation two hundred & Sixty two Acres it being a Moiety of five hundred & twenty five Acres which was devised by the Last Will & Testament of Ralph Vickers deceased to the said Thomas Boykin & Simon Boykin to be equally devided between them as by the said Will Recorded in the County Court of Isle of Wight relation being thereunto had may more fully & at large appear In pursuance of which Devise the said Thomas & Simon Boykin by mutual Consent have divided the Same by a Line of Marked Trees beginning at the Head of aSmall Branch issuing out of the Mill Swamp of Richard Cocke Gent. to a White Oak in Benjamin Jenkins's Line And also all that Tract or Parcel of Land Containing eighty five Acres adjoining to the aforesaid two hundred & Sixty Acres which was granted to the said Ralph Vickers by Patent bearing Date the fifteenth Day of December 1749 & by the Decease of the said Ralph is descended & Come to the said Thomas Boykin as he [is; obscurred] Heir at Law And all Houses Outhouses Woods Underwoods Gardens Orchards Trees Ways Waters WaterCourses Profits Com'odities Heredit= =aments & Appurtenances to the said Peices or Parcels of Land belonging or in any wise appertaining And the Reversion & Reversions Remainder & Remainders Rents Issues &Profits thereof & of every part and parcel there of and all the Estate Right Title Interest Claim and Demand whatsoever of them the said Thomas Boykin & Mary his wife of in & to the Same and every part and parcel there of with the Appurtenances and all Deeds Evidences & Writings touching or in any wise Concerning the Same To have and to hold all &Singular the said Premises with the [page break] [p.] 325 ŻŻŻŻ Appurtenances unto the said Joshua Wombwell his Heirs and Assigns ["forever and the said Thomas Boykin for" struck] To the only Use and behoof of the said Joshua Wombwell his Heirs and Assigns forever and the said Thomas Boykin for himself his Heirs Ex'ors and Adm'ors Doth Covenant Promise & Grant to and with the said Joshua Wombwell his Heirs and Assigns forever by these Presents in manner & form following that is to Say That he the said Thomas Boykin at the Time of ensealing & delivery of these Presents hath good Right full Power & Lawfull Authority to Sell & Convey all &Singular the abovementioned Premises with the Appurtenances unto the said Joshua Wombwell in Fee Simple and that he is Seized of a good and indefeazable Estate in Fee Simple at the Time of the Executing this Coveyance and that the said Joshua Wombwell his Heirs and Assigns Shall &may from Time to Time & at all Times for ever hereafter peaceable & quietly have hold use occupy Possess & enjoy the said premises with the Appurtenances free Clear and discharged of and from the Lawfull Lett Disturbance Molestation Eviction Title Claim and Demand of any Person or Persons and from all Dowers Intails Mortgages Debts Judgments Executions and other Incumbrances of what Nature or kind Soever and that he the said Thomas Boykins and his Heirs the said Premises with the Appurtenances unto the said Joshua Wombwell his Heirs and Assigns against all & every Person and Persons whatsoever Lawfully Claiming or to Claim the Same Shall &will Warrant &for ever defend by these Presents And Lastly that he the said Thomas Boykins and his Heirs and all & every other Person and Persons Claiming by from or Under him Shall and will from ["& to" struck] Time to Time & at all Times forever hereafter at the Reasonable Request Costs & Charges in the Law of him the said Joshua Wombwell his Heirs or Assigns make execute & acknowledge or Cause and Procure to be made executed &acknowledged any further or other Act or Acts Thing or Things Conveyances or Assurances in the Law for the better &more perfect Conveying & assuring the Said premises with the Appurtenances unto the said Joshua Wombwell his Heirs and [page break] [p.] 326 ŻŻŻ Assigns as by the said Joshua Wombwell his Heirs or Assigns or his or their Counsell learned in the Law Shall be Lawfully & reasonably devised or required In Witness where of the Parties to these Presents have hereunto interchangeably Set their Hands & affixed their Seals the Day &year above written Signed & Delivered Thomas Boykin /Ls/ In Presence of her Thos: Williamson Mary + Boykin /Ls/ Edmond Jinkins mark Simon Boykin John Harris Matthew Powell Memorandum That on the Twentysecond Day of November 1751 full Possession and Seizin was had & taken of the Messuage Tenements & Premises within granted by Thomas Boykin and by him delivered to the Said Joshua Wombwell To hold to him his Heirs and Assigns for ever according to the True Intent &Meaning of the within written Indenture Witness Thos. Williamson Edmond Jenkins Thomas Boykin Simon Boykin John Harris Matthew Powell At a Court held for the County of Southampton or Thursday the 14th. Day of February 1752 This Indenture & Memorandum were proved by the Oath of Edmund Jenkins & Simon Boykin two of the Witnesses thereto and At a Court held for the said County on Thursday the 14 Day of May 1752 The said Indenture & Memorandum were further proved by the Oath of John Harris a Witness thereto & Ordered to be Recorded Test Rd. [& tiny check mark] Know all Men by these Presents that we Thomas Boykin and Simon Boykin of Southampton County and Daniel Herring the younger of the County of wight are held and firmly bound unto Joshua Wombwell of the Said County of Southampton in the full Sum [page break] [p.] 327 ŻŻŻ of Two hundred pounds To be paid to the said Joshua Wombwell his Certain Attorney Executors and Admrs: and Assigns to the which payment well and truly to be made We bind ourselves our Heirs ["and" struck] Ex'ors and Adm'rs Jointly and Severally firmly by these Presents Sealed with our Seals and Dated this Twenty fifth Day of November 1751 The Condition of this Obligation is Such that if the above bound Thomas Boykin his Heirs Execrs: or Adminrs: Shall well and truly observe Perform fulfill and keep all and Singular the Covenants Grants Articles and Agreements mentioned and Comprized in a Certain Indenture of Feoff Baring Date the 22 Day of November and mentioned to be made between the above bounded Thomas Boykin and Mary his wife of the one part and and the Said Joshua Wombwell of the other part which on the part and behalf of the Said Thomas Boykin are and ought to be observed Performed fulfilled and kept then this Obligation to be void or Else to Remain in force power and Virtue Sealed and Delivered } Thomas Boykin /Ls/ in presents of } Simon Boykin /Ls/ ...Thos.
