JOHNSON Deed of Trust This Indenture Made this 26.th day of January one thousand eight-hundred & eighty-seven between Moody A. MUMFORD and Susan [page break] [p.] 212 [margin notes] Exam'd Tax .50 E. his wife of the County of Southampton & State of Virginia, of the one part; and A.T. STEPHENSON Chosen as trustee for the purposes herein Named, of the other part = Witnesseth: That- The said Moody A. MUMFORD and Susan E. his wife, do grant, with 'general Warranty,' unto the said A.T. STEPHENSON trustee as aforesaid, the following property, to wit: All that tract, piece or parcel of land situated, lying & being in, the County of Southampton in the State of Virginia, & bounded and described as follows: It his [sic] Adjoining the lands of Thomas J. LOWE and others, and is known as a part of the original T.J. LOWE Tract; it being the same Which was conveyed by deed on the 25.th day of January 1887 from S.W. JOHNSON and wife to the said Moody A. MUNFORD, and on which pc, the said Moody A. MUNFORD, now resides- Containing (50) fifty acres, More or less, together with all and singular the appurtenances belonging to the same, [The above deed of bargain & sale was recorded on pp. 112-13 of Deed Book 39, which were missing when the volume was microfilmed.] In Trust- to secure to S.W. JOHNSON of the County of Isle of Wight, in the State of Virginia, the payment of the sum of $150.00 One hundred and fifty dollars in two equal installments, the bonds for which bear date from the 9.th day of January 1887 with interest, payable as follows, viz. one on the 1.st day of January 1888, the other on the 1.st day of January 1889. And it is covenanted & agreed between the parties aforesaid, that in case of a sale the same shall be made after first advertising the time, place & terms thereof for thirty (30) days, and upon such terms as the said Trustee shall direct; & after paying the expenses of executing this Trust, if then unpaid, including a commission of five per cent, to the said Trustee, there to discharge the amount of Money, principal and interest, there due and unpaid of the said debt; and the residue, if any, pay as the ban directs. It is also covenanted and agreed that this Deed of Trust shall secure any bonds given in renewal or curtail of the aforementioned, Covenants to pay all taxes, assessments, dues & Charges upon the said property- so long as he or his heirs shall hold the same, and to keep the said property insured for a reasonable amount for the benefit to the said; and should the said party of the first part fail to keep the said property so insured, then the said [blank] shall insure the same & make the premium a charge of release is it shall be at the cost of the said party. In all other respects this Deed shall be executed According to law governing trust sales, secured herein, in whole or in part, sale shall be made, & if there be more than one secured, then sale shall be Made in case there be default no payment either in whole or in part of the first. MUNFORD Whose names are signed to the foregoing writing, bearing date the 26.th of January, 1887, personally appeared before me in the County aforesaid, and being duly examined by me privily and apart from her husband, & having the Writing aforesaid fully explained to her, she, the said Susan E. MUNFORD, acknowledged the said writing to be her act, and declared that she had Willingly executed the same, & does not wish to retract it. Given under My hand this 26.th day of January 1887. R.A.
