All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records John CRUMPLER to Thomas WILLIAMSON, deed of mortgage, 175 acres &c, 4 Jul 1754 (12 Sep 1754) [margin note] Williamson from Crumpler This Indenture made this fourth Day of July In the year of our Lord Christ One thousand Seven hundred & fifty four Between John Crumpler of the Parish of Nottoway in the County of Southampton Planter of the one Part and Thomas Williamson of the Same Parish and County Merchant of the other part Whereas the said John Crumpler Stands justly indebtred to the said Thomas Williamson in the Sum of thirty three Pounds five Shillings & eleven pence Wares and Merchandize by the said Thomas Williamson to the said John Crumpler sold & delivered at his special for divers Goods ^ instance and request Now this Indenture Witnesseth That the said John Crumpler as well for Securing the payment of the said Sum of Money as also for and in Consideration of the Sum _.. _.. _.. of five Shillings by the said Thomas Williamson to the said John Crumpler in Hand paid at or before the Sealing & Delivery of these Presents the Receipt whereof he doth hereby acknowledge and thereof acquit and discharge the said Thomas Williamson his Heirs Executors & Administrators forever by these presents Hath Granted Bargained & Sold and by these Presents Doth Grant Bargain & Sell unto the said Thomas Williamson and to his Heirs and Assigns forever Ten Head of Nett Cattle and one Mare Bridle & Saddle and also All that the said John Crumpler his Plantation Tract or Parcel of Land whereon he now lives Situate lying and being in the aforesaid Parish of Nottoway & County of Southampton Containing by Estimation One hundred and Seventy five Acres be the same more or less One hundred and fifty Acres part thereof is part of a Tract or Parcel of Land purchased by the said John Crumpler of one Philip Rayford by Indenture of Feoffment bearing Date the twenty third Day of December one thousand Seven hundred & twenty three Recorded in the County Court of Isle of Wight Relation being thereunto had may more fully and at large appear and twenty five acres the Residue is part of a Certain Tract of Land which was given & devised to the said John Crumpler by the Last Will & Testament of his Father William Crumpler dec'ed And all Houses Outhouses Edifices Buildings yards Gardens Trees Ways Waters Water Courses Profits Commodities Hereditaments and Appurtenances to the said Tract or Parcel of Land belonging or in any wise appertaining And the Reversion and Reversions Remainder and Remainders Rents Issues & Profits thereof and all the Estate Right Title Interest Use Trust Benefit Claim and Demand of him the said John Crumpler of in or to the Same or eany part thereof To have and to hold the said Plantation Tract or Parcel of Land and Premises with the appurtenances unto the said Thomas Williamson his Heirs and Assigns To the only proper Use and behoof of the said Thomas Williamson his Heirs and Assigns forever Provided always [page break] [p.] 49) and these Presents are upon this Condition nevertheless That if the said John Crumpler his Heirs Executors or Administrators or some or one of them do and shall well & truly pay or Cause to be paid unto the said Thomas Williamson his Heirs Executors Administrators or Assigns to to Some or one of them the said Sum of thirty three pounds five Shillings and eleven pence at or upon the third Day of July next en= =suing with Lawful Interest thereon to be Computed from the Date hereof until the same shall be fully Satisfied and paid that then this Indenture Shall Cease Determine and be utterly void And the said John Crumpler for himself his Heirs Executors and Administrators doth Covenant Grant and Agree to and with the said Thomas Williamson his Heirs Executors Administrators or Assigns that he the said John Crumpler his Heirs Executors or Administrators or some or one of them Shall well & truly pay or Cause to be paid unto the said Thomas Williamson his Heirs Executors Administrators or Assigns or to some or one of them the said Sum of thirty three pounds five Shillings and eleven pence with Lawful Interest thereon from the Date hereof at or upon the third Day of July next without Fraud Defalcation or Abatement And that the said John Crumpler and his Heirs Executors and Adm'ors Shall & will at all Times after default Shall be made of the Proviso or Condition - aforesaid Warrant and defend the before Granted Lands & Premises with the Appurtenances unto the said Thomas Williamson his Heirs and Assigns forever fom the Lawful Claim and Demand of all and every Person or Persons whatsoever And It is hereby agreed between the Parties to these Presents that until Default Shall be made of the Proviso or Condition aforesaid it shall & may be Lawful to & for the said John Crumpler to have hold use occupy and enjoy the premises herein before bargained & sold without the Lett and Disturbance of him the said Thomas Williamson or of any Person or Persons by his Means Consent or Procurement In Witness whereof the Parties to these Presents have hereunto interchageably Set their Hands and Seals the Day and year first above written Signed & Deliverd John Crumpler /Ls/ in Presence of Thos: Williamson /Ls Alexander Murray John Clayton Junr: John Lithgoe~ At a Court held for the County of Southampton on Thursday the 12th Day September 1754 This Mortgage was proved by the Oaths of Alexander Murray John Clayton junr. & John Lithgoe the Witnesses hereto and Ordered to be Recorded Test R. (Isle of Wight Co. DB1:389) Phillip RAYFORD [Sr.] sold it 23 Dec 1723 to John CROMPLER {CRUMPLER}. (Isle of Wight Co., VA, Great Book Vol. 2, pp. 638-39) William CRUMPLER left will 29 Oct 1750 {pr 14 Feb 1750/1} (Southampton Co. WB1:36-37); Thomas WILLIAMSON was a subscribing witness.
