All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records Joshua WOMBWELL to William RAND, deed of bargain & sale, 347 acres, 28 Oct 1754 (13 Feb 1755) [margin notes] Wombwell to Rand Sent to Simon Boykin who bought this land. ___ This Indenture made the twenty eighth Day of October in the year of our Lord one thousand Seven hundred and fifty four Between Joshua Wombwell of the Parish of Nottoway in the County of Southampton of the one Part and William Rand of the same Parish and County of the other Part Witnesseth the said Joshua Wombwell for and in Considera= =tion of the sum of one hundred and twenty five Pounds Current Money to him in Hand Paid by the said William Rand at or before the ensealing and delivery hereof the Receipt whereof the said Joshua Wombwell doth hereby acknowledge and thereof acquit and Discharge the said William Rand Have and hath Granted Bargained sold aliened enfeoffed and Confirmed and by these Presents Do and Doth Grant Bargain sell alien enfeoff and Confirm unto the said Wm: Rand his Heirs and assigns forever all that tract or Parcel of Land lying and being in the said Parish of Nottoway and County of Southampton Containing by Estimation three hundred and forty seven Acres be the same more or less it being the Land that the said Joshua Wombwell Purchased of one Thomas Boykin which by a Deed Recorded in Southampton Court may more fully appear and Bounded as followeth Beginning at the Head of a Small branch issuing out of the Mill Swamp of Richard Cocke Gent: to a White oak in Benjamin Jenkins Line so along the aline of Marked Trees to a Gum on Black Water Swamp, so Down the Various Courses of the Run to the mouth of the aforesaid Mill swamp then up the Various Courses of the Run to the beginning Containing by Estimation three hundred and forty seven acres be the same more or less And all Houses out Houses Trees Woods UnderWoods Gardens Orch'ds Tree Ways Waters WaterCourses Profits Commodities Hereditaments and Appurtenances to the said Piece or parcel of Land belonging or in any wise appertaining and the Reversion and ~ Reversions Remainder & Remainders Rents Issues and Profits thereof and of every Part and [page break] [p.] 59) Parcel thereof and all the Estate Right Title Interest Claim and Demand whatsoever of him the said Joshua Wombwell of in and to the same and every Part and Parcel thereof with the appurtenances and all Deeds Evidences and writings touching or in any wise Concerning the same To have and to hold all and singular the said Premises with the appurtenances unto the said William Rand his Heirs and Assigns To the only Use and behoof of the said Wm. Rand his Heirs and assigns forever and the said Joshua Wombwell for himself his Heirs Ex'ors and Adm'ors Doth Covenant promise & Grant to and with the said Wm. Rand his Heirs and Assigns forever by these Presents in manner & form following that is to say that he the said Joshua Wombwell at the time of ensealing and delivery of these presents hath good Right full Power and Lawful authority to sell and Convey all and Singular the above mentioned Premises with the appurtenances unto the said Wm. Rand in Fee Simple and that he is Seised of a good and indefeasable Estate in fee Simple at the time of the Executing this Conveyance and that the said Wm: Rand his Heirs and Assigns shall and may ~ from time to time and at all Times forever hereafter Peaceably and Quietly have hold Use ~ Occupy Possess and enjoy the said Premises with the Appurtenances free Clear and discharged of & from the Lawful lett Disturbance Molestation Eviction Title Claim and Demand of any Person or Persons and from all Dowers Intails Mortgages Debts Judgments Executions and other incumbran =ces of what Nature or kind soever And that he the said Joshua Wombwell and his Heirs the said ~ Premises with the appurtenances unto the said William Rand his Heirs and Assigns against all and every Person and Persons whatsoever Lawfully Claiming or to Claim the same shall and Will warrant and forever Defend by these Persents And Lastly that he the said Joshua Wombwell and his Heirs and all and every Person and Persons Claiming by from or Under him shall and will from Time to Time and at all Times forever hereafter at the Reasonable Request Costs and Charge in the Law of him the said William Rand his Heirs or Assigns make Execute and acknow =ledge or Cause and Procure to be made Executed and Acknowledged any further or other Act or Acts thing or things Conveyances or Assurances in the Law for the better and more Perfect Con =veying and assuring the said Premises with the appurtenances unto the said Wm: Rand his Heirs and assigns as by the said Wm: Rand his Heirs or Assigns or his or there Counsell learned in the Law Shall be Lawfully ~ [erasure] ~ and Reasonably devided or Required In Witness Whereof the Party to these Presents have hereunto interchangeably Set his Hand and Affixed his Seal the Day and year first above Written Signed and Delivered } In the Presence of ~ } Joshua Wombwell /L.S./ Benja: Pynes Adam Brown Andrew Sikes James Forsyth Memorandum that on twenty eighth Day of October one thousand seven hundred and fifty four full Possession and Seison was had and taken of the Messuage.
