Britt This Indenture made this twelfth day of March in the fourth year of the Reign of sovereign lord George the third by the Grace of god of great Britain France & Ireland King defender of the faith &c and in the year of our Lord Christ one thousand seven hundred and sixty four Between William Mercer of the parish of Notoway in the county of Southampton planter of the one part and John Britt planter of the other part in the same parish & county Witnesseth that the said William Mercer for and in consideration of the sum of fifteen pounds currant money of Virga. to him in hand paid by the said John Britt the recipt whereof he doth hereby acknowledge & thereof acquit and discharge the said John Britt hath granted Bargained sold aliend enfeoffed and confirmd and by these presents doth grant bargain sell alien enfeoff and confirm unto the said John Britt and to his heirs & assigns for ever all that tract or percel of land situate lying and being on the south side of black water swamp in the parish & county aforesaid containing by estimation one hundred Acres be the same more or less and bounded as followeth beginning at a lightwood Post, near a white oak mentioned in the after mentioned patent thence from the said white oak, north north east one hundred and thirty two Pole to a light wood post thence north seventy degrees west eighty six Pole to a pine by the side of Tarripin Branch thence down the various courses of the run of the said Branch to the fork thence up the fork to a line of Markt trees at the head thereof made by William Coleson & Robert Mercer thence along the said line of markt trees to the first station being part of a tract of land granted to the said William Mercer by a deed bearing date the fourteenth day of august one thousand seven hundred & forty nine being thereunto had may more fully and at Large appear And all houses outhouses edifices Buildings yards gardens Orchard woods underwoods trees ways waters water courses profits commodities Hereditaments and appurtenances thereunto belonging or in any wise appertaining and the revertion and revertions remainder & remainders rents Issues & profits thereof and of every part and parcel thereof and all the estate right title Interest property claim and demand what ever of him the said William Mercer of in or to the same or any part thereof and all deeds Evidences and writings touching or in any wise concerning the said premises To have and to hold the said tract or or percel of land and premisses with the appurtenances unto the said John Britt and to his Heirs and assigns to the only use & behoof of the said John Britt his Heirs & Assigns for ever and the said William Mercer for himself his heirs Ex'ors And Adm'rs doth covenant promise and grant to and with the said John Britt his Heirs Assigns forever by these presents in manner & form following that is to say that he the said William Mercer at the time of ensealing and delivering of these presents hath good right full power and lawfull Authority to sell & convey all & singular the said tract or percel of Land and premisses with the appurtenances herein before mentioned unto the said John Britt in fee simple and that the said William Mercer is seised of a good and indefeasible estate in fee in the same at the time of executing this conveyance and that the said John Britt his heirs and assigns shall & May at all times for ever here after peacebly and Quietly have hole use occupy Possess and enjoy the said [page break] [p.] 292) premises with the appurtenances free clear and discharged of and from the title claim and demand of every person or persons and from all Dowers intails mortgages Debts Judgments and executions and all other incumberances of what nature or kind soever and also that the said William Mercer and his Heirs and assigns against and his Heirs the said tract or percel of land and premises with the appurtenances unto the said John Britt his Heirs & Assigns against all & every person and persons whatsoever Lawfully claiming or to claim the same shall & will warrant and forever defend by these presents in Witness whereof the said William Mercer hath hereunto set his hand and affixed his seal the day & year first above written.
