Moody ____ This Indenture made this first Day of October anno Domini one Thousand Seven hundred & Seventy two between Sophia Rand & Lewis Almond acting Executors of the last will & Testament of William Rand late of Ile of weight County & John Rand of the County of Johnson in the province of North Carolina son & heir at Law of the said William Rand of the one part & Philip Moody of the County of Southampton of the other part, Whereas the said William Rand Decd. did by his last will & Testament bearing Date the third Day of November one Thousand Seven hundred & Sixty Seven & recorded in the County of Ile of weight order his Estate of what kind soever after his widow had received her third for dower to be sold to the hiest bidder & equally Divided among his Children, In pursuance to the said will & Testament the said Executors made sale of the said Estate & one tract of the Lands fell in the hands of one Philip Moody Party hereto as highest bidder & to the end that no dispute might thereafter arise concerning the will or any claim hereafter made by the heir at Law the said John Rand was at the sale consented thereto & agreed to relinquish all pretention thereto by Joining himself as a party in these presents, now this Indenture witnesseth that the said Sophia Rand Lewis almond & for & in consideration of the sum of Fifty Pounds Current money of Virginia to them in hand paid at or before the sealing & delivery of these presents the said John Rand for & in Consideration of Equal part of the aforesaid money pursuant to the will aforesaid the reciept whereof the Sophia Rand Lewis almond & John Rand Doth hereby acknowledge and thereof acquit & Discharge the said Philip Moody his heirs Ex'ors & Administrators for ever Will Hath pursuant to the aforesaid ^ granted bargained sold & Confirm;d & doth by these presents grant bargain & confirm [page break] [p.] 475 unto the said Philip Moody one certain Tract or parcel of land lying & being in the County of Southampton & on the South side and Joining black water River containing by Estimation one hundred acres be the same more or less and bounded as follows Vizt. Beginning at the Run of the main black water Swamp at Edward Boykins lines so along the said Boykins line to a cross branch which divides this Land from Richard Jacksons so along the run of the said branch to the run of the main black water Swamp so down the run of the said swamp to the first station being a Tract or parcel of Land purchaced by the said William Rand Dec'd. from Josiah John Holliman by a deed of bargain &Sale Date the ninth Day of August one Thousand seven hundred and Fifty nine and recorded in Southampton County records reference thereto being had may more fully appear and the Revertion and revertions remainder and remainders Rents Issues and profits thereof and also the Right Title Interest claim and Demand whatsoever from the said Sophia Rand Lewis almond and John Rand and their Heirs for in and to the aforesaid premises or any part or parcel thereof.
