All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Deeds John JOHNSON to Joseph & William SCOTT, of Nansemond Co., deed of mortgage- 640a., slave & personal property, 13 Jul 1775 [margin notes] Johnson to J & W Scott carried to Apl. court 1796 for J Randolph This Indenture Made this thirteenth day of July one thousand seven hundred and seventy five Between John Johnson of Henry of the parish of Nottoway in the county of Southampton planter of the one part and Joseph and William Scott of the parish aforesaid in the county aforesaid of the other part Witnesseth that the said John Johnson of Ken* for and in consideration of the sum of one hund- red and thirty three pounds three shillings and four pence one fathing to him in hand paid by the said Joseph and William Scott at or before the sealing and delivery of these presents the receipt whereof he doth hereby acknowledge and thereof acquit and dis- charge the said Joseph and William Scott their executors and administrators by these presents hath granted bargained Sold aliened released and confirmed and by these presents doth grant bargain sell alien release and confirm unto the said Joseph and William Scott and to their heirs and assigns for ever all that plantation tract or parcel of land whereon the said John Johnson of Kin now lives containing by estimation six hundred and forty acres more or less together with one Negro fellow called Robin and four work horses and two Beds together with all houses outhouses edifices buildings woods ways waters water courses profits commodities hereditaments and appurtenances whatsoever to the said plantation, tract or parcel of land belonging or in any ways ["wise" overwritten] appertaining and the Reversion and Reversions Remainder and Remainders Rents issues and profits thereof and all the estate right title and interest of him the said John Johnson of Kin of in and to the same any and every part thereof To have and to hold the said plantation tract or parcel of land and premises with the appurts and the said goods and chattles unto the said Joseph and William Scott their heirs and assigns for ever to them and their only proper use and behoof for ever provided alwais and upon the condition that if the said John Johnson of Ken, his hiers Executors or Administrators or [page break] [p.] 167 or some of them do well and truly pay or cause to be paid unto the said Joseph and William Scott their hiers Executors or Adminis =trators or assigns on or before the first day of January next ensuing the date hereof the said sum of one hundred and thirty three pounds three shillings and four pence one fathing with interest thereon from the day of the date hereof untill the same shall be fully paid and satisfied then this present Indenture shall cease determine and become utterly void and the said John Johnson for himself Executor Administrator doth covenant promise and agree to and with the said Joseph and William Scott their Executor adm'tor or assigns by these presents that he will well and truly pay or cause to be paid unto the said Joseph and William Scott their Executors Administrators or assigns on or before the said first day of January next the said sum of One hundred and thirty three pounds three shillings and four pence fathing with interest thereon from the day of the date hereof untill the same shall be fully satisfyed and paid as aforesaid and lastly it is covenanted and agreed by and between the parties to these presents that till breach or nonperformance of the proviso or condition aforesaid the said John Johnson his hiers and assigns shall and may peacable and quiately have hold use occupy and enjoy the above bargained land and premises goods and chattles without the let suit or interruption of them the said Joseph and William Scott their hiers or assigns or any other person claiming under them or any of them In Witness whereof the said John Johnson hereunto sett his hand and seals this day and year first above written Sealed and Delivered John Johnstone -(:(:)- in the presence of John Scott John Brown Jacob F Randolph Received this thirteenth day of July 1775 of Joseph and William Scott Merchants the full sum of one hundred and thirty three pounds three shillings and four pence one fathing lawfull money of Virginia it being the consideration money within mentioned Teste John Johnson Jacob F Randolph John Scott John Brown At a Court Held for the County of So.ampton the 13th.
