All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Deeds Ann (GRAY) BLUNT, widow of Thomas BLUNT, to Edwin GRAY & William THOMAS, executors of Thomas BLUNT, & Mills GODWIN, deed of trust, real estate, slaves & personal property, 16 Feb 1781 (13 Nov 1783) [margin notes] Blunt ---} to } Gray &c.} This Indenture Made this sixteenth day of February, in the Year of our Lord Christ one thousand seven Hundred and Eighty one, Between Ann Blunt Widow and Relict of Thomas Blunt late of the County of Southampton deceased of the One part, and Edwin Gray, William Thomas, and Mills Godwin of the other part Whereas the said Thomas Blunt, in his Life time was Seized of a Considerable Estate in the said County and Being so seized and Possessed made his last Will and Testament Bearing date the 26th. day of September 1777 Duly Proved and Recorded in the Court of the said County, wherein amongst other things by the said Will he lent to his Loving wife Ann (the said Ann party hereto) dureing of her natural life the use of the plan =tation whereon he then lived with the Lands adjoining, also the use of the Plantation, he purchased of Henry Brown's Ex'ors, also use & labour of the Following negroes (to wit) Jack, Walley Great Judy, Patt, Little Judy Morea, & Hannah, and also gave to the said Ann and her Heirs forever, all his Househould and Kitchen furniture all his Plantation utencils Together with his stocks of all kinds (except a mare) with Divers other Legacies given to his Children and Further Directed that all the legacies Given to his Children shou'd remain in the Possession of his wife untill such Children shou'd Severally Arrive at the age of twenty one Years or Intermarry and by the said Will further Bequeathed that all the Remainder of his Estate of every kind shou'd be to his said Wife Ann and her heirs Now this Indenture Witnesseth, that the said Ann Blunt as well in Consideration of the natural Love and affection which She hath for the Children which she had by the said Thomas Blunt and for their Advancement in the world, as also for and in consideration of the sum of Five shillings to her in hand Paid by the said Edwin Gray, William Thomas, & Mills Godwin or either of them at or before the Ensealing and Delivery [page break] [p.] (52) of These Presents the receipt whereof she doth hereby acknow =ledge, Hath granted, Bargained Sold aliened assigned and set over and by these Presents Doth grant Bargain sell alien assign and set over unto the said Edwin Gray, William Thomas and Mills Godwin, or either of them, and to their Executors and Adm'ors. all that the aforesaid Ann Blunt her right Title inter =est & Term yet to come of in the Aforesaid Plantation and Tracts of land Together with all the negroes, except Morea and Hannah, and all the personal chattels except one Bay mare, Rocket a side Saddle and One Feather Bed and furniture, so as aforesaid given, and Devised to her the said Ann Blunt, in and by the last Will and Testament of the said Thomas Blunt Dec'd. as by the said Will,__ will more fully appear and also all Profits that hath Arisen from the said Estate by increase of stock, or by any other ways or means whatsoever since the Death of the said Thomas Blunt, unto the day of date of these presents, In trust, nevertheless & upon this special Trust, and Confidence in them reposed, that, they the said Edwin Gray, William Thomas, and Mills Godwin, or either of them, shall after takeing Possession of the estate Hereby Conveyed, Employ the Money ariseing from the rents, sales or, Profits, Thereof to the sole use and Benefit of the Children, now, Surviving of the said Ann Blunt by the said Thomas Blunt. the Testator, _ after paying such Debts are due from the sd. Ann Blunt for the board, and schooling of her Children, and all other debts that hath acreed on account of her Children ~ Aforesaid or any of them and for all other necessary Expences For the benefit of the said Estate,_ in equal proportions, and to no other use intent or purpose whatsoever, and that the said Edwin Gray, William Thomas, and Mills Godwin_ their heirs, Executors, or administrators, shall and will at the Death of the said Ann Blunt, deliver up to the Executors of the said Thomas Blunt all the Lands, Slaves, and other Estate [page break] [p.] (53) Estate devised to the said Ann Blunt, For the term of her life, to and for the uses and Purposes by the said Will directed That the said Edwin Gray, William Thomas, & Mills Godwin, Trustees Herein before named or either of them their Executors and adm'ors. shall chargeable with and accountable for only such estate or money's as may actually come to their hands or be received by them or either of them out of the prem =ises, not the one for the other and be saved harmless for all costs and expences, they shall sustain by reason of the trust aforesaid, and the said Edwin Gray, William Thomas, & Mills Godwin for themselves their Heirs Ex'ors. adm'ors. & assigns, do hereby Covenant Promise and Grant, to and With the said Ann Blunt her heirs Executors and adm'ors, that the said Edwin Gray, William Thomas and Mills Godwin, shall and will Dureing the term aforesaid well and Truly Perform the trust and Confidence Hereby Reposed in them or either of them in all Things on their Parts Hereby directed to be Performed In Witness Whereof the Parties have here unto Interchangeably set their hands & Seals The Day & year first above Written - Signed Sealed & Delivered} Ann Blunt ĪSealĪ } Interlined before} In Presence of ..........} Assigned.........} Edwin Gray ĪSealĪ his Drury x Cotton --..} mark } William Thomas ĪSealĪ her } Henrietta x Joyner } mark } Mills Godwin ĪSealĪ John Redwood __ __ } At a Court a Court Held Southampton County the 13th. day of September 1781 This Indenture was partly Proved by the Oaths of Drury Cotton and John Redwood Two of the [page break] [p.] (54) The Witnesses Thereto And at a Court Held for the said County the 13th. Southampton Co., VA, Deed Book 6 (1782-1787), pp. 346-49; file at: http://files.usgwarchives.net/va/southampton/deeds/06db346.txt They sold another tract, estimated at 710 acres, to Jesse WHITEHEAD, but he died before the "deeds of Conveyance were perfected." They conveyed the tract to Arthur WHITEHEAD, Jesse's nephew, 9 Dec 1784 (10 Sep 1788). Southampton Co., VA, Deed Book 7 (1787-1793), pp. 113-16; file at: http://files.usgwarchives.net/va/southampton/deeds/07db113.txt Later deeds state this tract - surveyed to be 783 acres, not 710 - came to Arthur WHITEHEAD, who sold it back to Thomas BLUNT's executors, 10 Dec 1784, who then re-sold it the same day to William WHITEHEAD, who then conveyed it in a deed of trust, 17 Dec 1789 (pr. 8 Apr 1793*), to trustees John BARROW, Nicholas MAGET [MAGETTE], Arthur WHITEHEAD & James WILKINSON, for the benefit of BLUNT's executors. Those trustees then sold the tract to Thomas EDMUNDS, 15 Aug 1791 (pr. 13 Oct 1791). Southampton Co., VA, Deed Book 7, pp. 341-43, 570-71 *The court minutes for this session are not extant - the recorded sessions that month were "continued & held ... the 10th. day of April 1793" & 11th. (Southampton Co., VA, Court Minute Book 1793-1798, p. 8) Thomas EDMUNDS' son Etheldred EDMUNDS sold the 783-acre tract & one of 170 acres to Robert RICKS Sr., 23 Apr 1813 (17 May 1813).
