All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Deeds Benjamin HARRISS [HARRIS] & wife Elizabeth (MILLER) to Burwell WILLIAMSON, deed of bargain & sale, 21 Jan 1786 (12 Jul 1786) [p.] (535) This Indenture made this Twenty first day of January, One thousand seven hundred and eighty six Between, Benjamin Harriss, and Elizabeth Harriss of the County of Southampton of the one Part, and Burwell Williamson of the Aforesaid County of the other part, Witnesseth, that the said Benjamin Harris and Elizabeth Harris for and in consideration of the sum of one hundred and Seventy pounds Current money of Virginia, the receipt whereof they the said Benjamin Harris Doth hereby Acknowledge hath Granted bargained, sold, aliened, enfeoffed & conf= =irmed, and by these [presents] doth grant bargain sell alien enfeoff and Confirm unto the said Burwell Williamson his heirs and Assigns forever, one Certain tract or parcel of Land, lying and being in the county aforesaid, Containing by estimation Two hundred & eight acres more or less and bounded as follows Begining at a Cedar a corner of the said Harris's and William Williamson deceased, Thence south east by South sixty seven pole to a hickory, thence South eighty Two degrees East forty four pole to a Gum by the side of the Piney branch thence up the Various Courses of the run of the said branch to a small Sweet Gum, a corner of Harmon Harris's land, thence south eighty seven degrees East Seventy pole to a pine, thence North thirty seveven [sic] Degrees East fifty two pole to a small white Oak, thence north Twenty one Degrees West thirty two Pole to a pine Harmon Harris's Corner, thence north thirty four degrees West to a Spanish Oak a corner of the said Harris's and Williamson Lands, thence by a line of marked Trees a divideing Line between the said Benjamin Harris and Said Burwell Williamson to a black gum, a corner of the said Burwell Williamson Benjamin Harris and William Williamson Deceased, thence along the said William Williamsons line to the Begining Seventy five acres of the above said land, being part of a pa= =tent granted Robert and John Harris, bearing date the 8th. day of September 1720. the remainder 133, being part of a patent of 367 acres granted to Burwell Williamson on third Day of August 1771,. To have and [to] hold the aforesaid Land [page break] [p.] (536) Land with all houses, Out houses, Gardens, woods, ways and waters, with all other Priviledges, profits, Commodites and Advantages Whatsoever to the said land belonging or in any ways appurtaining unto the said Burwell Williamson his heirs and Assigns forever, in as full and ample manner to all intents and Purposes, and I do hereby further covenant promise and grant to and with the said Burwell Williamson his heirs and Assigns that the said land and every part and parcel thereof is free and clear from all other gifts grants or Mortgages. and all other Incumbrances whatsoever, in the which I do hereby Transfer and oblige myself, my heirs and Assigns, to warrant and Defend this my sale of all and Singular the premises, Together with their and every of their Appurtenances unto him the said Burwell Williamson his heirs and assigns forever, against and all and every Other person or Persons, shall and will warrant and forever defend by these Presents In Witness whereof we the said Benjamin Harris and Elizabeth Harris have to these Presents set our hands and Affixed our Seals the day & year first above Written ~ Signed Sealed & Delivered} Benjamin Harris ¤Seal¤ in presence of ___ ___ __} ¯ her E. Holliman } mark William White } Benjamin White } John Williamson } Brittain Boykin } [dingbat>] see the Receipt left out by mistake } ¯¯¯¯¯¯¯¯¯¯¯ Southampton Sct: The common Wealth of Virginia to Elias Herring, Micajah Holliman and David Barrow Gentlemen greeting Whereas Benjamin Harris and Elizabeth his wife by their certain indenture of Bargain and Sale Dated the Twenty first day of January 1786 ___ Have conveyed the fee simple estate of and in one certain Tract or Parcel of land containing two hundred and eight Acres to Burwell Williamson, as Whereas the said Elizabeth cannot conveniently travel to the Court of our said County to relinquish her right of Dower in the same as the Law directs, These are [margin notes] [page break] [p.] (537) Therefore to command you or any two or more of you Personally to go to the said Elizabeth and examine ~ privately, and apart from her said Husband whether she hath executed the Deed hereunto annexed without the persuasion or threats of her said Husband, & whether she is willing that the same shou'd be Recorded in the Court of our said County of Southampton, & when you have examined her as Aforesaid, That you distinctly & Plainly certify us thereof, under your hands & Seals ~ returning to us also this Writ Annexed to the said Indenture, Witness Samuel Kello clerk of our said Court at his Office the 23rd. day of January 1786 in the 10th. Kello Cl. ~^~ Southampton Scilicit / / By Virtue of the within commission to us directed, we do hereby certify that we did go to the said Elizabeth party to the Indenture hereunto annex'd, and did examine her privately and apart from her husband And do further certify that she the said Elizabeth, said she did freely and Voluntarily relinquish her right of dower in the said Indenture, without the pursuasion of Threats of her Husband, And that she is willing it should be recorded in the county court of Southampton, Given under our hands this 25th. day of January 1786. _____ Elias Herring Micajah Holliman At a Court held for the County of Southampton the 12th. Day of July 1786. ___ This Indenture and the receipt thereon endorsed were partly proved by the Oaths of Benjamin White, & John Williamson, two of the witnesses thereto, And at a court held for the said County the 14th. day of September 1786, the said Indenture was Acknowledged by Benjamin Harris one of the parties hereto, and with a commission hereto annex'd, and Together with a certificate thereof thereon endorsed of the ~ acknowledgement of the said Elizabeth are Ordered to be ~ Recorded _____ Teste Saml.
