All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Deeds Barnabas "Barnaby" DRAKE Sr. & wife Mary to Axum [Exum] DRAKE, deed of bargain & sale, 100 acres, 7 Jul 1790 (9 Jul 1790) [margin notes] Barnaby Drake & wife to Axum Drake This Indenture made this seventh day of July in the year of our lord Christ one thousand seven hundred and ninety Between Barnaby Drake Senr. and Mary his wife of the County of Southampton and state of Virginia of the one part and Axum Drake of the County and state aforesaid of the other part Witnesseth that the said Barnaby Drake Senr. and Mary his wife for and in Consideration of the sum of five pounds good and lawful Money of the state aforesaid already in hand paid them by the said Axum Drake the receipt of which said sum the said Barnaby Drake Senr. and Mary his wife doth hereby acknowledge and themselves thereof ~ fully and entirely satisfyed Contented and paid hath Bargained sold aliened enfeoffed and Confirmed and by these presents doth bargain sell alien enfeof forever Confirm unto the said Axum Drake his heirs and assigns a certain tract or parcell of land in the [page break] [p.] 340 County aforesaid lying on north Side of Flaggrun Swamps Joining the land of Jacob Barnes formerly Jacob Barnes's Geo: Washington Senr. and Glebe Land Containing by estimation one hundred acres and bounded as followeth Vizt. Begining at a black oak, a corner of the Glebe Land thence binding on the Glebe ['Land" overwritten] Line north forty two Degrees west eighty six pole to a white oak north twenty six degrees west thirty four poles to a pine north Ten degrees East thirty four pole to a red oak thence north forty degrees east forty pole to a pine in the white root percoson [sic; pocosin] thence north sixty three degrees east forty pole to a white oak Saplin thence South twenty two poles to a white oak in the line of John Barnes now Jacob Barnes south Seventeen degrees west hereby six pole thence &c as well more hereby appear by the patent Bearing date, the granted to the said Barnaby Drake and for the line to or made according to the quantity of Acres hereon Contained &c _ Together with all houses Gardens waters water Courses mines and minerals and all other the profits and Commodities thereto belonging or in any wise appertaining To have and to hold the said Bargained premises with the appurten= ances unto the said Axum Drake his heirs and assigns forever with the Reversion and reversions remainder and remainders Rents Issues and profits thereof and every part and parcel thereof to his only proper use and behoof forever and the said Barnaby Drake and Mary his wife Senr. at the time of the signing and Sealing of these Presents stands lawfully Seizd. and possessed of in and to the said Bargained Premises in a good and pure estate in fee simple and that the same is fully freely and clearly acquitted from all manner of incumbrances whatsoever and that they the said Barnaby Drake Sr. and Mary his Wife hath a good right and lawful authority to Sell and Convey the said Tract of land unto the said Axum Drake his heirs and assigns forever and Lastly the said bargained premises with the appurtenances unto the said Axum Drake his heirs and assigns they the said Barnaby Drake Senr. and Mary his wife their heirs & assigns will warrant and forever defend by these presents against the Lawful Claim of all and every person or persons whatsoever and whomsoever In Witness whereof they the said Barnaby Drake Sinr. and Mary his wife have hereunto interchangeably set their hands ___ [page break] [p.] (341 and Seals the day and date first above Written ~ Signed Sealed and Delivered} his In Presence of _________ } Barnaby + Drake ¤seal¤ Josiah Vick mark William Drake her his Mary + Drake ¤seal¤ Simmons + Drake mark mark her Sarah + Drake mark Memorandum that on the Seventh day of July Anno Dom 1790 quiet and peaceable possession and Seizen of the aforesaid land was given and delivered by the said Barnaby Drake Sinr. and Mary his wife unto the said Axum Drake to hold to him his heirs and assigns forever according to the True Intent & meaning of the above Deed In Presence of us ~ Josiah Vick his William Drake Barnaby + Drake Senr. his her Simmons + Drake Mary + Drake mark mark her Sarah + Drake mark Received this Seventh day of July one thousand seven hundred and ninety of the aforesaid Axum Drake the Just and full sum of five [blank] being in full of the Consideration above Mentioned by Me his Witness Barnaby + Drake Josi. Vick mark William Drake his Simmons + Drake mark her Sarah + Drake At a Court held for the County of Southampton the mark 10.th day of June 1791 This Indenture with the Memorandum and receipt thereon endorsed were Proved by the of Josi.
