All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Deeds Barnabas "Barnaby" DRAKE Jr. to Miriam SCOTT, deed of trust, 100 & 50 acres & personal property, 20 Oct 1790 (10 Feb 1791) [margin notes] Barnaby Drake to Miriam Scott Carried to March court 1797 [sic*] Ex.d This Indenture made this Twentieth day of October in the year of our Lord Christ one thousand seven hundred and Ninety Between Barnaby Drake J.r of the County of Southampton and parish of Notoway [sic] of the one part & Miriam Scott of the County and parish aforesaid of the other part Witnesseth that the said Barnaby Drake for and in Consideration of the just and full sum of Fifty four Pounds ten Shillings and ten Pence half penny Current money of Virginia by the said Mirriam [sic] Scott to him in hand paid the receipt whereof he the said Barnaby Drake doth hereby acknowledge & thereof _ acquit and discharge the said Miriam Scott her heirs and assigns for ever and himself therewith fully and entirely satisfyed Contented and paid he the said Barnaby Drake hath Granted bargained sold aliened enfeof= fed released setover delivered and Confirmed and by these presents doth grant bargain sell alien enfeoff release setover deliver and Confirm unto the said Miriam Scott and to her heirs and assigns for ever all that messuage _ tract and parcel of land which the said Barnaby Drake bought of John Oberry by Indenture bearing date in or about the year 1779 [underlined] Situate lying and being in the County of Southampton and parish of Notoway aforesaid Containing by estimation one hundred acres be the same more or less bounded and discribed [sic] as by the said Oberry's deed is expressed and declared also one Certain Messuage tract and parcel of land situate in the County and parish aforesaid Containing by estimation fifty acres and being all the lands which the said Barnaby Drake bought of Brittain Joyner being particularly discribed [sic] and bounded as by the said Brittain Joyners deed to the Said Barnaby Drake is expressed and declared and all the houses out houses edifices - [page break] [p.] 458 buildings woods ways waters and water courses gardens orchards profits Commodities hereditaments and appertenances whatsoever to the same belonging or in any wise appertaining and the reversion and reversions remainder & remainders rents issues and profits thereof & all the estate right title interest Claim or demand of him the said Barnaby Drake of in and to the same and every part and parcel thereof also three horses fifteen head of Neat Cattle four feather beds & furniture all my pewter and stock of hogs all my plantation implements & all my house hold and kitchen furniture of every kind To have and to hold the s.d Plantation messuages tracts and parcels of lands and premises goods and chattels unto her the said Miriam Scott and to her heirs and assigns forever to the only proper use & behoof of her the s.d Miriam Scott and her heirs and assigns & the said Barnaby Drake for himself his heirs executors adm'rs and assigns the said Plantation Messuages tract and parcels of lands and premises with all and every the appertenances as aforesaid together with all and every the other granted premises goods and Chattles unto her the said Miriam Scott and to her heirs and assigns forever against him the said Barnaby Drake his heirs ex'ors adm'rs & assigns and _ against all and all manner of persons whatsoever claiming or demanding the same or any part parcel or article thereof shall and will warrant & forever defend by these presents and the said Barnaby Drake for himself his heirs Executors adm'rs and assigns doth hereby Covenant promise& agree to [margin notes] Examined ~"~ and with the said Miriam Scott her heirs ex'ors adm'rs and assigns that he the said Barnaby Drake his heirs executors adm'rs and assigns will well & Truly pay or cause to be paid unto the said Miriam Scott her heirs or assigns the just and full sum of fifty four pounds ten Shillings and ten pence half penny like Current money, With the lawful Interest thereon growing due on or before the last day of Dec.r and upon the special Condition this Indenture is to be void and the said Barnaby Drake his heirs or assigns is to repossess the said granted premises as fully and as amply or [sic;
