Britt To Britt Jr. This Indenture made this nineth day of Feb:y in the year of our lord one thousand seven hundred and ninety one Between Britain Britt acting executor of the last will and Testament of John Britt dec'd of the one part and Benjamin Britt Jr. (both of the County of South= ampton) of the other Part Whereas John Britt dec'd [page break] [p.] 617 did by his last will and Testament leave his land and Plantation to be sold and the money to be equally divided between his four sons Benjamin Joseph Beasant and Arrington Britt which said will has been duly proved and recor= ded in the court of the said county of Southampton and the said Britain Britt has taken the burthen of the execution thereof. Now. this Inden= ture therefore witnesseth that as well to Carry the intentions of the said Testator into effect as for and in consideration of the sum of one hundred and forty Pounds by the said Benjamin Britt jr. to the said Britain Britt the Ex'or aforesaid paid (which said Benjamin became the purchaser of the land and Plantation in the said will mentioned at Public [sale]) the sd. Britain Britt hath granted bargained sold aliend releas; and confirmd and by these Presents doth grant bargain sell alien enfeoff and confirm unto the said Benjamin Britt jr. and to his heirs and assigns all that Plantation tract or parcel of land containing by estimation one hundred and seventy five [acres] more or less being the whole of the land whereof the said John Britt dec'd seized and possessed and whereon he resided at the time of his death & is Situated on black water in the County aforesaid and bounded as is express'd in a deed from Thos. Williamson dec'd to the said John Britt which had been duly proved and recorded in the court of the county aforesaid reference being had thereto may more fully and at large appear and all houses out houses edifices buildings yards gardens woods ways waters water courses profits commodities hereditaments and appertances thereunto belonging or in any ways appertaining and the reversion and reversions remainder and remainders rents issues and services thereof and of every part and parcel thereof To have and to hold the said Plantation tract or parcel of land and Premises with the apperten =ances unto the said Benjamin Britt and to his heirs and assigns to the only Proper use and behoof of him the said Benjamin Britt jr. his heirs and assigns forever And the Said Britain Britt Executor &c. of the said John Britt dec'd Pursuant to the trust reposed in him by his Testator doth hereby covenant and agree to and with the said Benjamin Britt jr. that he the sd. A transcription of the deed (DB3:161-62) is posted at: http://files.usgwarchives.net/va/southampton/deeds/03db161.txt The 1786 will of John BRITT named as his executors Benjamin BRITT and William CRUMPLER (who refused). It is not clear from the records how Britain BRITT became the acting executor [the Order Books are missing].
