Court 1795. No. 2nd. Lot This Indenture made this 12 day of January Anno dom 1794 Between Edwin Gray Saml. Kello Benja. Blunt Thomas Ridley Benjamin Ruffin Robert Goodwyn & John Taylor Gentlemen Trustees as herein after mention'd of the one part and John Wright of the county of So.ton of the other part witnesseth that whereas an act of the General Assembly of Virga. passed Decr. the 7th 1791, Intitled an act to establish certain Towns & other purposes hath enacted that Ten Acres of Land adjoining the courthouse in the county of So.ton the property of Joseph & Wm. Scott should be and was thereby vested in Edwin Jas. Wilkinson Gray ^ Saml. Kello Benja. Blunt Thos. Ridley Benja. Ruffin Robt. Goodwyn & John Taylor Gentlemen trustees to be by them or a majority of them laid of into lots of an half acre each with convenient Streets and establish a Town by the name of Jerusalem and whereas the said act hath further directed that the sd. Trustees or a majority of them shou'd Proceed to sell the sd. lots at Public auction for the best price that could be had for the same & hath impower'd the sd. trustees to convey the Same to the purchasers thereof in fee, upon certain conditions which may be more particularly Known by a reference to the aforesd. Act Now this Indenture witnesseth that the sd. Edwin Gray Samuel Kello Benja. Blunt Thos. Ridley Benja. Ruffin Robt. Goodwyn & John Taylor Gen. Trustees as aforesd. for and in consideration of the sum of £39,,1,,0 current money of Virga. to be paid by the said John Wright pursuant to the aforesd. Act to the sd. Joseph & Wm. Scott former proprietors of the sd. lots or their legal representa tives have bargained sold alien'd & confirm'd & by these Presents do bargain Sell alien & confirm unto the sd. John Wright to him and his heirs forever one lot or parcel of land lying and being in the sd. Town of Jerusalem & bounded as follows Viz Beginning at the side of the courthouse ground on the West side of the main Street thence along the main Street 100 feet 4 Inches to the corner of No. 3 thence along the line of No. 3 _ 237 feet 6 Inches to the River thence up the river 100 feet 4 Inches to the corner of the courthouse ground thence along the line of the said ground 198 feet to the beginning, together with all the Profits priviledges & Appurts. whatsoever to the sd. Premises belonging or in any ways appertaining To have and to hold the sd. lot or Parcel of land with the appurts. as aforesaid to the sd. John Wright to him & his heirs forever & the sd. John Wright for him himself and his heirs do hereby covenant & agree with the sd. Trustees in the manner & form following Vizt. that he the said John Wright or his heirs shall & will build on the sd. Lott a dwelling house 16 feet Square at least with a brick or stone chimney to be finish'd fit for habitation within five years from the date of these Presents and also do punctually pay the money arising from the Sales of the said lot to the Proprietors of the said lot or their Legal representatives and the said trustees do covenant & agree with the said John Wright and his heirs well & truly Performing all and every the covenants & agreements which on his part by the true intent & meaning of these presents they ought to per form may peaceably & quietly enter upon have hold Possess & enjoy all the Premises with the appurts. above mention'd without the let trouble or hindrance of them the said Trustees or any those Person, or Persons claiming under them or any of them provided always that if the said John Wright and his heirs do and shall fail to build thereon within the time herein before Limited for that Purpose that the Trustees above sd. may thence immediately enter into the aforesd. lot and Sell it again pursuant to the recited [act.] [page break] [p.] 87 whereof In Witness ^ ["we" struck] the Parties to these Presents have hereunto interchangeably set our hands and affixed our seals the day and year above ["written" struck] said Sign'd Seal'd & delivered Benja.
