Britt and Catharine his wife of the county of So.ton of the one part and Wm. Boykin of the sd. county of the other part Witnesseth what the sd. Matthew Britt and Catharine his wife for and in consideration of the Sum of Forty pounds current money of Virginia to them in hand paid by the said Wm. Boykin on or before the Sealing and delivery of these presents the receipt whereof we the sd. Mattw. Britt and Catharine his wife doth hereby acknowledge hath granted bargain'd & Sold alien'd releas'd and confirm'd and by these Presents doth grant bargain Sell alien release & confirm unto the sd. William Boykin his heirs and assigns forever one certain tract or parcel of land Situate lying and being in the county of So.ton, containing by estimation 80 Acres more or less & bounded as fol loweth [page break] [p.] 88 follows to wit Beginning at a red oak on the main road leading to Brod Water on Micajah Hollimans line thence along a line of mark'd trees to a Maple in Long on Absalom Williamson's line & thence a line of mark'd trees to a Spruce Pine a corner tree on the said Absalom WmSon's line thence, a long a line of mark'd trees to a Pine on the main road leading to Brod Water long the main road to the beginning. To have and to hold unto the said William Boykin his heirs & assigns forever and also the remainder and remainders reversion & reversions rents & Issues & profits of the said tract or Parcel of land to the only Proper use & behoof of him the sd. Wm. Boykin, his heirs and assigns forever and the said Matthew Britt & Catharine his wife for them selves their heirs and assigns doth covenant grant and agree to & with the sd. Wm. Boykin that he the sd. Mattw. Britt the lawfull title in fee Simple of the said land against all persons claiming by from or through the said Matthew Britt & against all and every person whatsoever warrant & forever defend In Witness whereof Mattw. Goodson } mark Southampton Sct. The commonwealth of Virga. to Robert Goodwyn & John Urquhart Gentlemen justices of the peace for the county of Southampton Greeting whereas Mattw. Britt & Catherine his wife of the county of Southampton & Parish of Nottoway by their certain Indenture of bargain & Sale dated this 12th day of Septr. in the year of our Lord 1793 sold & conveyed unto Wm. Boykin of the county of Southampton aforesd. the fee Simple estate of in one certain tract or Parcel of land containing 80 acres be the same more or less and bounded as is express'd in the sd. Indenture situate lying and being in the aforesd. county of So.ton. and whereas the said Catharine Britt cannot convenien ly trave to our court of our said county of So.ton to make acknowledgement of the Same we there fore command you or any two or more of you to go personally to the said Catharine Britt and Examine her Privately & a part from her said husband whether she has executed executed the sd. deed freely & Voluntarily without the Persuasion or threats of her sd. husband & whether she is willing that the sd. Indenture should be recorded in the court of our sd. county of So.ton and when you have Examin'd her as aforesd. and taken her acknowledgement of the said Indenture that you distincly and openly certify us thereof under your hands & Seals returning to us also this writ with the sd. Indenture annex'd Witness Saml. Kello clerk of our sd. court at his Office the 3th day of Augt. 1793 and in the 18 Year of the Commonwealth S. Kello Cl. Southampton Sc. By Virtue of a dedimus Potestatom[?] to us directed we have gone to the house of Wm. Boykins and Examine'd Catharine Britt (wife of Matthew Britt) Privily and apart from her husband [page break] [p.] 89 and do hereby certify that she freely and Voluntarily with[out] any threats or persuasion of her sd. husband Executed the sd. Indenture hereto annex'd & that she is willing the same should be recorded in the court of our county of So.ton Given under our hands & Seals this 14 day of Sept. 1793 Robert Goodwyn _ ĪLSĪ Jno. Urquhart __ ĪLSĪ At a court held for the county of So.ton the 14 day of Feby 1794 This Indenture and the receipt thereon endors'd was Prov'd by the oaths of Jeremiah Summerell & Willm. Goodson two of the witnesses thereto and continued for further proof At a court held for the sd. county of So.ton the 12 day of June 1794 This Indenture and the receipt thereon endors'd was acknowledged by Matthew Britt party thereto and with the commission of the Privy Examination of Catharine Britt and a certificate of the Execution thereof Ordered to be recorded S.
