No. 12. lot This Indenture made this 15th day of Novr. Anno dom 1794 Between Edwin Gray Samuel Kello Benja. Blunt Thos. Ridley Benja. Ruffin Robert Goodwyn & John Taylor Gentlemen Trustees as herein after mention'd of the one part & Willis Woodley of the county of So.ton of the other part Witnesseth that whereas an act of the General Assembly of Virga. pass'd Decr. the 7th. 1791. entit= led an act to establish certain Towns and other Purposes hath enacted that ten acres of land adjoining the Courthouse in the county of So.ton the Property of Joseph & Wm. Scott should be & was [page break] [p.] (139 ŻŻŻ [margin notes] Examined & Delivered to Sally Doyal present owner of Lott No. 12 March 15th. 1831 - thereby vested in Edwin Gray James Wilkinson Samuel Kello Benja. Blunt Thos. Ridley Benja. Ruffin Robert Goodwyn & John Taylor Gentlemen Trustees to be by them or a majority of them laid off into Lots of an half acre each with convenient streets and establish a Town by the name of Jerusalem & whereas the said act hath further directed that the sd. Trustees or a majority of them should proceed to Sell the sd. lots at Public auction for the best price that could be had for the Same & hath impower'd the sd. Trustees to convey the same to the purchasers thereof in fee, upon certain conditions which may be more Particu -larly known by a reference to the sd. Act Now This Indenture witnesseth that the sd. Edwin Gray Saml. Kello Benja. Blunt Thomas Ridley Benjamin Ruffin Robt. Goodwyn & John Taylor Gentlemen Trustees as aforesaid for and in consideration of the Sum of twelve pounds one shilling current money of Virga. to be paid by the said Willis Woodley Pursuant to the aforesd. act to the sd. Joseph & William Scott former Proprietors of the sd. lots or their legal representatives have bargain'd Sold alien'd & confirm'd and by these Presents do bargain Sell alien & confirm unto the sd. Willis Woodley To him & his heirs forever & lot or parcel of land lying in the sd. Town of Jerusalem & bounded as follows Viz Be -ginning at the corner made by the South side of the Cross Street & the east side of the main Street thence along the main Street 90 feet 4 Inches to the North west corner of No. 11 thence along the line of No. 11 two hundred & thirty Seven feet 9 Inches to Scotts line thence along Scotts line 90 feet 4 Inches to the the Cross Street & thence along the cross Street 237. feet 9 Inches to the beginning together with all the Profits Priviledges & appurts. whatsoever to the sd. premises belonging or in any ways appertaining To have & to hold the said lot or Parcel of land with the Appurts. as aforesd. to the said Willis Woodley to him and his heirs forever & the said Willis Woodley for himself & his heirs do hereby covenant & agree with the said trustees in manner & form following Vizt. that he the said Willis Woodley or his heirs shall & will build on the said lot a dwelling house 16 feet Square at least with a brick or Stone chimney to be finish'd fit for habitation within five years from the date of these Presents & also do Punctually pay the money arising from the Sales of the said Lot to the Proprietors of the said Lot or their legal representatives and the said Trustees do covenant & agree With the said Willis Woodley & his heirs that the said Willis Woodley & his heirs will & truly Performing all & every the ["appurts" struck] covenants & agreements which on his part by the true intent & meaning of these Presents they ou- ght to Perform may Peaceable and quietly enter upon have hold Possess & enjoy all the premises with the appurtenances above mention'd without the let trouble or hindrance of them the said Trustees or any those Person or Persons claiming under them or any of them Provided always that if the said Willis Woodley & his heirs do & Shall fail to build thereon within the time herein before Limited for that Purpose that the trustees above said may thereupon immediately enter into the aforesaid lot & Sell it again Pursuant to the recited Act in witness whereof the parties to these Presents have hereunto interchangeably set our hands & affix'd our Seals the day & year above said Sign'd Seal'd & delivered in Presence of Benja.
