Dd. to Ch.s Bailey Sep.r 25 1796 This Indenture made this the 11.th day of February in the year of our Lord 1796 Between John Bailey of the county of Southampton of the one part & Charles Bailey of the county aforesaid of the other part Witnesseth that the said John Bailey for and in consideration of the sum of five shillings to him in hand paid by the said Charles Bailey at & before the Sealing & delivery of these Presents the receipt whereof the said John Bailey doth hereby acknowledge he the said John Bailey hath granted bargain'd & Sold alien'd enfeoff'd & confirm'd & by these Presents for himself his heirs & assigns doth grant bargain & Sell alien and confirm unto the said Charles Bailey his heirs & assigns forever one certain tract or Parcel of land containing 295 acres more or less lying & being in the county of Southampton (being a tract of land purchased [page break] [p.] 248 by the aforesaid John Bailey of Benjamin Philips by his deed bearing date the 8.th day of August in the year of our Lord 1765, a reference being thereunto had will more fully appear) and bounded as followeth (to wit) Begining at a red oak on the North Side of the Lightwood Swamp thence by a line of mark'd trees to a Poplar in the Cabbin branch thence down the said branch to the Lightwood Swamp thence up the said the Swamp to the Begining and the reversion & reversions remainder & remainders rents & Services of the said Premises also all the estate right title Interest claim & demand of him the said John Bailey & his heirs of in or to the said land & Premises & every part & Parcel thereof To have and to hold the said land & Premises with the appurt.s herein before mention'd unto the said Charles Bailey his heirs and assigns forever & the said John Bailey for himself his heirs and assigns and from all & every other Person or persons whatsoever claiming & demanding the said land & Premises doth hereby warrant & forever defend unto the said Charles Bailey his heirs & assigns to the only Proper use & behoof of him the said Charles Bailey his heirs and assigns forever In Witness whereof the said John Bailey hath hereunto Set his hand and affix'd his Seal the day & year first above written Sign'd Seal'd & deliver'd John Bailey ¤seal¤ In Presence of Jordan Judkins } his } Tho. + Brittle} mark } Memorandum that on 11.th day of February 1796 peaceable & quiet Peter Bailey } Possession and Seisen of the land withinmention'd was had & taken by John Bailey within mention'd and by him delivered to the within named Charles Bailey To hold to him his heirs & assigns forever: according to the form & Effect of the within written Indenture Witness Jordan Judkins } John Bailey ¤seal¤ his } Tho. + Brittle } mark } Peter Bailey } At a court cont.d & held for the county of Southampton 11.th day of February 1796.
