Cary Jan.y 17.th 1797 by Harry This Indenture tripartite made this the 17.th day of July 1795 Between Littleton Scholar, James Woodson, Henry Woodson, Bob Wineoake, Jimmy Wineoake, Tom Turner, Lucy Rogers, Edy Turner, Nanny Woodson, Nancy Wott, Betty Step, for ourselves & in behalf of Wm_ Gabriel & Nancy Turner who are absent and also for and in behalf Solomon Step, Ann Woodson &c infants of the Nottoway tribe of Indians of the first part & James Wilkinson, Thomas Vaughan, James Millar, John T. Blow, Thomas Ridley & Robert Goodwin Gentlemen Trustees as herein after mention'd of the Second part and Miles Cary of the county of Southampton of the third part Witnesseth that [page break] [p.] (249 whereas by an act of General Assembly of Virginia entitled an act concerning the Nottoway tribe of Indians pass'd the 12.th day of November Anno Domini 1792 James Wilkinson, John T. Blow, Tho.s Vaughan, Ja.s Millar, Thomas Ridley and Robert Goodwin Gent. were appointed trustees of the s.d Indians and by the said act it was renderded lawful for the said tribe of Indians under the directions & with the approbation of the said trustees or any five of them to Sell upon 12 Mo. Credit a tract of land lying in the said county which had been leas'd to certain Persons in the year 1772 & which lease was about to expire in the year 1793 & upon such Sale the said trustees or any 5 of them were authoris'd & impowered to join the said Indians in conveying the same to the purchaser or Purchasers in fee. Now this indenture witnesseth that the said Indians & the said James Wilkinson, Thomas Vaughan, James Millar, John T. Blow, Thomas Ridley & Rob.t Goodwyn Gent. Trustees as aforesaid joining with the said Indians for and in consideration of the Sum of £100. to be paid to the said trustees or their Successors by the aforesaid Miles Cary & for the payment whereof the said Cary has given bond with approvd Security pursuant to the above recited act have bargain'd & Sold alien'd & confirm'd & by these Presents do bargain & Sell alien & confirm to the said Miles Cary & his heirs and assigns forever one tract or parcel of land being a part of the said tract mentiond in the above recited act containing by Estimation 201 acres & bounded as follows Viz. Begining on the Edge of the low grounds of the buckhorn Swamp on the West Side of the Swamp at the buckhorn bridge thence along the Buckhorn road to a Hickory a corner tree in the line of N.o 2 thence along the line of N.o 2 to the Beaver dam branch thence down the Various courses of the run of the said branch to buckhorn Swamp & up the edge said the lowgrounds of buckhorn Swamp to the begining on the aforesaid West side of the Swamp together with the Profits & advantages hereditaments & appurtenances whatsoever to the said tract or parcel of land in any wise belonging To have and to hold the said tract of land to the said Miles Cary to him and his heirs forever & the said Indians for themselves & their Posterity the said tract of land & Premises against themselves & their Posterity & against all and every other Person & Persons whatsoever to the said Miles Cary & his heirs by these Presents do & shall warrant & forever defend & the trustees the s.d tract of land & Premises against themselves & against all and every other Person or Persons claiming under them or any of them to the said Miles Cary & his heirs by these Presents do and Shall warrant & forever defend In testimony whereof we the parties to the presents have hereunto set our hands & affix'd our Seals the day & year above written Sign'd Seal'd & deliver'd his In Presence of Littleton + Scholar ¤LS¤ Jam.s Wilkinson ¤LS¤ Theo.s Scott } mark Bates Wrenn } his his } James + Woodson ¤LS¤ Tho.s Vaughan ¤LS¤ Benj. x Newsum} mark mark } his Teste } Henry + Woodson ¤LS¤ Ja.s Millar ¤LS¤ John Barlow ju. } mark Ja.s Irwin } his Johann CasparHose} Bob + Wineoake ¤LS¤ Jn.o T.
