Ruffin Robert Goodwyn and John Taylor gentlemen trustees as herein after mentioned of the one part and John Crichlow of the county of Southampton of the other part; Witness that whereas an act of the general assembly of Virginia passed December ye. seventh, One thousand seven hundred and ninety one entitled an act to establish certain towns, and for other purposes hath enacted that ten acres of land ad- =joining the courthouse of the county of Southampton the property of Joseph and William Scott should be and was thereby vested in Edwin Gray James Wilkinson Samuel Kello Benjamin Blunt Thomas Ridley Benjamin Ruffin Robert Goodwyn and John Taylor gentlemen trustees to be by them or a majority of them laid of into lots of an half acre each with convenient Streets and establish a town by the name of Jerusalem And whereas the said act hath further directed that the said trustees or a majority of them should proceed to sell the said lots at publick Auction for the best price that could be had for the same and hath empowered the Said trustees to convey the same to the purchasers, [page break] [p.] 348 thereof in fee, upon certain conditions which may be more particular Known by a reference to the said act now this Indenture witnesseth that the said Edwin Gray James Wilkinson Samuel Kello Benjamin Blunt Thomas Ridley Benjamin Ruffin Robert Goodwin and John Taylor gentlemen trustees as aforesaid for and in consideration of the sum of nine pounds current money of Virginia to be paid by the Said John Crichlow pursuant to the aforesaid act to the said Joseph & William Scott former proprietors of the said lots or their legal representatives have bargained sold aliened and confirmed and by these presents do bargain sell and confirm unto the said John Crichlow and his heirs forever one lot or parcel of land lying and being in the sd. town of Jerusalem and bounded as follows, Vizt. Beginning at the corner of No. 18. adjoining the courthouse square then along the line of the said Square No. 26° W 112 feet 2 inches to the corner in the line of No. 20 then along the line of No. 20. No. 67° E 173 feet 6 Inches to the corner of No. 20 thence S 29° E 112 feet 2 inches to the corner of No. 18 thence along the line of No. 18. 184 feet to the beginning together with all the profits privelidges and appurtenances whatsoever to the said premises belonging or in any wise appurtaining. To have and to hold the sd. lot or parcel of land with the appurtenances as aforesaid to the said John Crichlow and his heirs forever and the sd. John Crichlow for himself and his heirs does hereby covenant and agree to [and with] the Said trustees in the manner and form fol =lowing Vizt. that the Sd. John Crichlow or his heirs shall and will build on the Said [lot] a dwelling house Sixteen feet square at least with a brick or stone chimney to be finished fit for habitation within five Years from the date of these presents as also do punctually pay the money arising from the Sale of the Said lots to the proprietors of the sd. lot or their legal representatives and the said trustees do covenant and agree with the said John Crichlow and his heirs well and truly performing all and every the covenants and agreements in which on their parts by the true intent and meaning of these presents they ought to perform may peaceably and quietly enter upon have Sole possess and enjoy all the premises with the appurtenances [page break] [p.] 349 above mentioned without the least trouble or hindrance of them the s.d trustees or any other person or persons claiming under them or any of them provided always that if the said John Crichlow and his heirs do and shall fail to build thereon within the time by the above recited act limited for that purpose that the trustees above named may there upon immediately enter into the afore[said] lot and Sell it again pursuant to the above Recited act in testimony whereof we the parties to these presents have hereunto interchangeably set our hands and affixed our Seals the day and year first above Said ~ { Benjamin Ruffin ĪSealĪ Signed Sealed and delivered } { James Wilkinson ĪSealĪ in presence of } { Robt.
