All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records Exum SCOTT & wife "Nancy" (Ann), of Isle of Wight Co., to Josiah VICK, deed of bargain & sale, 30¾a., Jerusalem, 11 Nov 1796 (15 May 1797); bond for right of dower, 11 Nov 1796 (15 May 1797) [p.] 442 [margin notes] Scott & Wife To Vick Dd. to Josiah Vick This Indenture made this eleventh day of November in the year of our Lord, one thousand seven hundred and ninety six, Between Exum Scott and Nancy his wife of the County of Isle of wight, and state of Virginia, of the one part, and Josiah Vick of the County and state, Southampton, of the other part Witnesseth, that the said Exum Scott & Nancy his wife, for and in consideration of the sum of forty three pounds ten Shillings, current money of Virginia, to them in hand Paid by the said Josiah Vick, at, and before the signing, Sealing, and delivery of these presents, the receipt whereof the said Exum Scott, and Nancy his wife, doth hereby acknowledge, and themselves, therewith fully satisfyed contented and paid, hath bargained, Sold, Alien'd, enfeoffed & confirmed and by these presents, doth hereby, bargain Sell, Alien, Enfeoff, and forever confirm, unto the said Josiah Vick, his heirs & Assigns, a certain Tract, piece or parcel of land, lying and being situated in the said County of Southampton, on the North side of Nottoway River, and bounded as follows (Viz) begining at a pine at the old church landing on Nottoway River, in John Underwood's line, thence North 70.° East 50 Pole to a Willer Oak, on the side of a Slash, thence binding on the said Slash North 44.° West 88 Pole to a large Pine a corner Tree, thence a line of marked Trees, South 54.° West 32 pole, thence South 46.° West 24 pole to the Town line, thence the said Town line South 29.° East 40 Pole to the South east corner of Joseph Holmes's Lott, thence South 67.° west 52 Pole to a sweet Gum on the bank of the River aforesaid thence down the said River South 16.° West 6 pole to the begining, containing by Survey (made by Wm. Wren, and laid down by a Scale of forty five pole to the Inch), twenty eight & three quarter Acres, be the same, more or less. __ Also two Acres land adjoining two Acres sold by said Scott to Doctr. Josiah Dashiel, lying between the River and road reading [sic; leading] out to broad water, and bounded as follows (Viz) Begining at the S.E. corner of Doctr. Dashiels Lott, thence North 16.° West 17 pole to a post, thence South 70.° West 24 pole to the Islands, thence down the Islands to the S.W. corner of sd. Dashiels lott, South 23.° East 18 Pole, thence along the said Dashiels line, North 71.° East 14 Pole to the begining, containing by Survey two Acres laid down by a scale of forty five pole to the Inch, by William Wren Surveyed the 20th. of January 1797, and the above 28¾ Acres, the 14th. of the same Month, devised to the said Exum Scott, by Joseph Scott & William Scott, Together with all houses, out houses, Gardens waters and water Courses, woods, under woods, Mines and Minerals and all other the profits and commodities & privileges thereto belong =ing or in any wise appurtaining_ To have & to hold the Said bargained premises with every of the appurtenances unto the Said Josiah Vick his heirs & assigns forever, with the reversion and reversions, remainder and remainders, rents Issues and profits there= of, and every part and parcel thereof, with all the estate right title claim, and demand, of them the said Exum Scott, and Nancy his wife their heirs Executors and Administrators, to the only proper use and behoof of the said Josiah Vick, his heirs, and Assigns forever.__ And the [page break] [p.] 443 said Exum Scott and Nancy his wife, for themselves, their heirs Exrs. and Administrators, do warrant promise, and grant, to and with the that he the said Josiah Vick his heirs & assigns said Josiah Vick, his heirs, and assigns, ^ shall and may from time to time, and at all times hereafter, peaceably, and quietly, have, hold use, occupy, Possess, and enjoy, the said Lands & premises, with every of the appurtenances, and receive, and Take the profits thereof, without the lett or molestation, of them the said Exum Scott & Nancy his wife, their heirs & assigns, or any person or persons whatsoever, And further, that they the said, Exum Scott, and Nancy his wife, and their heirs, and all and every person claiming, by, from or under them, any right title, or Interest, in the premises, aforesaid, or before mentioned [with the] appurtenances; shall and will from time to time, & at all times hereafter, at the reasonable request, and at the costs and charges in the law, of the said Exum Scott, and Nancy his wife their heirs, and assigns, make and execute, or cause to be made done and executed, all such further, and other acts and deeds, assurances, or conveyances in the law whatsoever, for the further, and more perfectly assuring the said land and premises with every of the appurtenances, unto the said Josiah Vick his heirs & assigns; as he the said Josiah Vick, his heirs or assigns or his or their counsel, learned in the law, shall be devised, advised, or required, and lastly that they the said Exum Scott and Nancy his wife, their heirs, all and singular the before mentioned premises, and every part and parcel thereof, with every of the appurtenances, unto the said Josiah Vick, his heirs & assigns, against them the said Exum Scott, & Nancy his wife, their heirs & assigns, and against all and every other person or persons, claiming, or to claim the same, shall, and will warrant and forever defend by these presents. Kello Cl. ~-¤-~ ______________________________________________________________________________ ¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯¯ [margin notes] Scott &c to } Vick } bond for } right of } dower } Dd. to Josiah Vick Know all men by these presents that, we Exum Scott of the County of Isle of Wight and are held and firmly bound unto Josiah Vick of the County of Southampton, and state of Virginia, in the just and full sum of five thousand Pounds Gold or silver money, agreeable to the present fineness; to be paid unto the said Josiah Vick, his certain attorney, his heirs Executors or Administrators or Assigns, to the payment whereof, we do bind our =selves, Jointly and severally, our Joint and several heirs, Executors and Administrators, firmly by these presents, Sealed with our Seals, and dated this Eleventh day of November 1796. _____ The Condition of the above Obligation is such that whereas the said Exum Scott hath sold and conveyed, unto the said Josiah Vick, a certain tract or parcel of land, lying in the said County of Southampton, adjoining the lands of John Underwood, and the town of Jerusalem, as by Deed bearing even date with these presents, will more fully appear, Also two Acres of land sold and conveyed in the same deed, adjoining a certain lott, sold by him to Doctr. Dashiel, lying and being situate on the south side of the main road leading out from the said Town of Jerusalem to broad water, and situated imme= diately from the said Town, except the Lott or Lotts of one or two acres, purchased of him by the said Doctr. Dashiel, Now if the wife of the [said] Exum Scott, shall voluntarily acknowledge her right of dower, when thereto requested, to the said Lands, according to Law, and the said Exum Scott, for himself, his heirs ex'rs. and administrators, shall at all times in any matter or cause [page break] [p.] 445 arising about the same land, hold the same good, and indefeesable unto the said Josiah Vick, his heirs, executors Administrators or assigns, without let, hindrance or molestation of himself, his heirs, executors, or Administrators, or any person or persons whatsoever, claiming the same, in any manner, or form what soever, that then the above Obligation to be void, or else to re= main in full force and Virtue ___ Signed Sealed & deld.} Exum Scott ¤Seal¤ In Presence of __ } ~-¤-~ W.
