All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Southampton County Virginia USGenWeb Archives Land Records Jerusalem trustees to William BLOW, Henry PARKER & Thomas VAUGHAN, deed of bargain & sale, Lot 16, Jerusalem, 17 Apr 1797 (17 Jul 1797) [margin notes] Jerusalem Trustees to Blow, Vaughan & Parker Examined and delivered to James Rochelle the present owner March 28th. 1834 This Indenture made this seventeenth day of April Anno Domini, one thousand seven hundred and ninety seven, Between Edwin Gray, James Wilkinson, Samuel Kello, Benjamin Blunt, Thomas Ridley, Benjamin Ruffin, Robert Goodwynn and John Taylor, Gentlemen Trustees, as herein mentioned, of the one part, & William Blow, Henry Parker & Thomas Vaughan of the County of Southampton of the other part Witnesseth that whereas an Act of the General Assembly of Virginia, passed Decemr. 7th. in the year of Christ 1791, entitled an Act to establish certain towns and for other purposes, hath enacted, that ten Acres of Land ajoining the Courthouse of the said County, the property of Joseph and William Scott should be, and was thereby vested, in Edwin Gray, James Wilkinson, Samuel Kello, Benjamin Blunt, Thomas Ridley, Benjamin Ruffin Robert Goodwyn & John Taylor, Gentlemen trustees, to be by them or a majority of them, laid off into Lotts of an half Acre each, with con= venient Streets, and establish a Town by the name of Jerusalem; And whereas the said Act, hath further directed that, the said trustees or a Majority of them, should proceed to sell the said lots, at public Auction, for the best price that Could be had for the same, and hath empowered the said trustees, to convey the same to the purchasers there of in fee, upon certain Conditions, which may be more particularly Known, by a reference to the said Act. Now this Indenture Wit= nesseth, that the said Edwin Gray, James Wilkinson, Samuel Kello Benjamin Blunt, Thomas Ridley, Benjamin Ruffin, Robert Goodwynn & John Taylor Gentlemen trustees, as aforesaid, for & in consideration of the sum of twenty four pounds current money of Virginia to be paid by the said William Blow, Henry Parker & Thomas Vaughan, pursuant to the aforesaid Act, to the said Joseph & William Scott, former proprietors of the said Lotts, or their legal representatives, have bargained, Sold, alien'd, enfeoffed & confirm, and confirmed & by these presents, do bargain, Sell, alien, enfeoff and confirm, unto [page break] [p.] 477 [margin note] Exd. the said William Blow, Henry Parker & Thomas Vaughan and their heirs forever, one lot or parcel of Land, lying and being in the said town of Jerusalem, being the lot Number sixteen of the said Town of Jerusalem, between the lots possessed by Thomas Vaughan & John T. Blow, and John Thomas Blow Junr. and adjoining the corner of the publick ground where the courthouse stands _ Together with all the profits, priviledges, and appurtenances whatsoever, to the said premises belonging, or in any ways appurtaining. To have and to hold the said lot or parcel of Land with the appurtenances, as aforesaid, to the said William Blow, Henry Parker and Thomas Vaughan, and their heirs forever. And the said William Blow, Henry Parker & Thomas Vaughan, for themselves and their heirs, do covenant & agree with the said Trustees, in the manner and form following Viz. that the said William Blow, Henry Parker & Thomas Vaughan or their heirs shall and will build on the said lot a dwelling house, sixteen feet square at least, with a brick or stone chimney to be finished fit for habitation on or before the seventh day of December in the year of Christ, one thousand eight hundred and one ensueing the date hereof, and also do punctually pay the money arising, from the sale of the said Lott to the proprietors of the said Lott or their legal representatives. And the said trustees do covenant and agree with the said William Blow, Henry Parker & Thomas Vaughan, and their heirs, well and truly performing all & every the Covenants and agreements, which on their parts by the true intent & meaning of these presents, they ought to perform, may peaceably and quietly enter upon, possess, and enjoy, all the primises with the appur =tenances above mentioned, without the lett or molestation, of them the said trustees, or every other person or persons claiming under them or any of them. Provided always, that if the said William Blow, Henry Parker & Thomas Vaughan, and their heirs, do and shall fail to build thereon, in the time above mentioned, that the said trustees above named, may thereupon, immediately enter into the aforesaid lott and sell it again, pursuant to the above recited Act _ In Testimony whereof, we the parties to these presents, have hereunto interchangeably set our hands and affix our Seals, the day and year first above written __ Teste James Wilkinson ĪSealĪ Robert Goodwyn ĪSealĪ At a Court held for the County of Thomas Ridley ĪSealĪ Southampton the 17th. day of July Ben.
