Fort Augt. 1807 Examined This Indenture made the 25th day of May, in the year of our Lord one thousand, seven hundred & ninety seven. Between Joseph Britt of the County of Southampton of the one part, and John Clements of the same County of the other part, Witnesseth that whereas the said Joseph Britt sold unto Samuel Moody of Isle of Wight , a certain tract of land in the Isle of wight County, containing four hundred Acres, more or less, and for the proper convey =ance and warranting the said land, entered into a bond, with the said John Clements as security, in the penalty of five hundred pounds to be paid unto the aforesaid Saml. Moody, in case the said Title of the land should prove defective- Now this Indenture witnesseth that the said Joseph Britt for and in Consideration of securing the said John Clements as well as that of having recd. the sum of one dollar, the receipt where of the said Joseph Britt doth hereby acknowledge, and thereof acquit and discharge the sd. John Clements and his heirs forever, hath granted bargained & sold, and by these presents doth grant bargain and Sell to the said John Clements the tract of land in Southampton which the said Joseph Britt Bought of Brittain Britt, and recorded in Southampton Court as may more fully appear __ and the reversions, remainder & remainders rents Issues & Profits & also all the Estate, right, title, Interest, claim or demand of him the said Joseph Britt his heirs or assigns of in and to the aforesaid premises. To have and to hold the aforesaid premises with all and sin= gular the appurtenances unto the sd. John Clements and his heirs forever to the only proper use and behoof of the said John Clements and his heirs in trust to and for the uses before mentioned, unto him the said John Clements & his heirs against him the said Joseph Britt & against his heirs & against the Claim, title, & demand of every person or persons whatsoever shall and will warrant and by these presents ever defend. Kello Cl Southampton Co., VA, Deed Book 8 (1793-98), p. 557 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 4 Virginia State Land Office Patents No. 22 (1743-1745), pp. 299-300 Additional information: This conveyance, in trust, was intended to indemnify John CLEMENTS, Joseph's security in a bond they executed, to warranty the sale by Joseph & his wife Elizabeth of Southampton Co. to Samuel MOODY of Surry Co., of 400 acres in Isle of Wight Co., dated 14 Dec 1796 (acknowledged 2 Jan 1797); file at: http://files.usgwarchives.net/va/isleofwight/deeds/18db097.txt Samuel MOODY won a judgement against BRITT & CLEMENTS, in District Court in Suffolk, and CLEMENTS paid the debt. John CLEMENTS' executor Francis CLEMENTS brought suit against the heirs of Joseph BRITT, but the suit was abated by Francis' death. Francis CLEMENTS' executor John URQUHART revived the suit and won judgement; the court decreed this tract be sold to satisfy the debt.
