This Indenture made this Sixteenth day of August in the Year of our Lord one Thousand seven hundred and Ninety eight Between Willis Woodley and Mary his Wife of the County of Gates State of North Carolina of the one part and William Washington of the County of Southampton and state of Virginia of the other part Witnesseth, that the said Willis Woodley and Mary his Wife for and in consideration of the just and full Sum of Forty five pounds current money of Virginia to them in hand paid by the said William Washington at or before the ensealing and delivery of of these presents, the receipt whereof is hereby acknowledged and they the said Willis Woodley & Mary his Wife doth thereof acquit and discharge the said William Washington his heirs and Assigns they the said Willis Woodley and Mary his Wife hath granted bargained and Sold, and by these presents doth hereby bargain sell alien, enfeoff, release setover, and forever confirm unto the said William Washington or his heirs or assigns forever one certain Lott or half Acre of Land, lying and being situate in the Town of Jerusalem in the aforesaid County of Southampton, and distinguished by the plan of the said Town by Number twelve (thus 12) and bounded, as follows (towit) Begining at the Southeast Corner of No. 11, thence along the said Lott No. eleven 237 feet 9 Inches to Scotts Land, thence a long Scotts Land by the Town line 90 feet 4 Inches to the Cross street thence along the Main street 90 feet 4 Inches to the begining; Together with all houses, out houses, Gardens, waters, Commodities & priviledges thereunto belonging, or in any wise appurtaining To have and to hold the said Lott or half Acre of Land unto the said William Washington his heirs and assigns forever, with the reversion and reversions, remainder and remainders, rents, Issues & profits thereof and every part and parcel thereof, with all the estate right Title, Interest, Claim and demand, of them the said Willis Woodley & Mary his Wife, their heirs & assigns and the said Willis Woodley & Mary his Wife doth hereby Covenant to & with the said William Washington his heirs or assigns, that at the time of the signing sealing & delivery of thes presents they have a good right & Legal authority to sell and convey the said Lott or half Acre of Land with every of the appurtenances aforesaid unto the said William Washington his heirs and Assigns, and that they Willis Woodley and Mary his wife for themselves, their heirs executors, administrators and assigns unto the said William Washington his heirs or assigns forever the said Lott or half Acre of Land & premises with every of the appurtenances shall and will warrant and forever defend in fee Simple against the lawfull Claim of all and every person and persons whatsoever & whomsoever In Witness whereof the said Willis Woodley & Mary his Wife have hereunto set their hands and affixed their seals the day and Year first above Written Willis Woodley ¤Seal¤ Signed Sealed & delivered} her in presents of __ __ - } Mary X Woodley ¤Seal¤ mark [page break] [p.] 685 Virginia. The Commonwealth of Virginia to David Rice and James Gregory Gentlemen justices of the peace for the County of Gates & State of North Carolina Greeting whereas Willis Woodley & his Wife Mary by their certain Indenture of bargain and sale dated the Sixteenth day of August one Thousand seven hundred & ninety eight conveyed unto William Washington of the County of Southampton, the fee Simple estate of and in a certain Lott or half Acre of Land in the Town of Jerusalem, with the appurtenances thereto belonging and whereas the said Mary Woodley cannot conveniently Travel, to the Court of our said County of Southampton to acknowledge the same Therefore we do give you power to receive the acknowledgmenent [sic] which the said Mary Woodley shall be willing to make before you of the conveyance aforesaid contained in the said Indenture which is hereunto annexed and we do give therefore command you to go personally to the said Mary Woodley and receive her acknowledgement of the same, and examine her privatly & apart from her sd. husband, whether she hath executed the said Deed freely and voluntarily without the persuasion or threats of her husband, and whether whe is willing the said Indenture should be recorded in the Court of the said County of Southampton and whn you have examined her as aforesaid, and taken her acknowledgment of the said Indenture that you distinctly and openly certify us thereof under your hands & seals, returning to us also this writt with the said Indenture annexed, Witness Samuel Kello Clerk of our said Court the fourteenth day of August 1798 and in the 23rd. Pursuant to the appended Order Court, we the Undersigned have taken the private Examination of Mrs. Mary Woodley, wherein she acknowledged that she freely and voluntarily assented to & signed the annexed Deed to William Washington of the County of Southamp= =ton (Virginia) and that she had executed the same without any Compulsion or threats of her Husband, but freely from her own voluntary free Will and accord,- David Rice ¤seal¤ Gates county 16th. At a Court continued & held for the County of Southampton the 21st. day of August 1798- This Indenture was acknowledged by Willis Woodley party hereto and with the Commission for the privy examination of Mary Woodley his Wife & a certificate of the examination thereof an ordered to be recorded _ Saml. Kello Cl. ~-¤-~ Southampton Co., VA, Deed Book 8 (1793-98), pp. 684-85 The Library of Virginia (LVA), Richmond, VA, Southampton Microfilm Reel 4 William WASHINGTON sold this lot to Joseph VICK, 30 Jan 1799 (1 Jul 1799); that deed also delivered to Sally DOYAL [DOYLE], 15 Mar 1831. VICK & wife Feriby sold WASHINGTON an 80a. tract on Nottoway Swamp on the same day, for the same price - $333.33. (Southampton Co. Deed Book 9:80-82) Eley JOYNER & wife Nancy (VICK) and Joshua HARROD & wife Martha (VICK) sold Lot 12 Sally DOYAL, 3 Nov 1828 (16 Feb 1829). (Southampton Co.
